notice to the licensees or other proceedings whatsoever; and publication in the Gazette of an Order in Council containing such revocation shall be sufficient notice to the licensees and to all persons concerned or interested that this Order in Council, and the rights and privileges thereby conferred, have been revoked and determined.

  1. In the event of this Order in Council being revoked for any reason whatsoever, or upon the expiry of the period for which the license is granted, the licensees shall, if required by the Minister so to do, remove the said wharf entirely from the site and restore the site to its original condition within three months from the date of revocation or expiry, as the case may be; and, if the licensees fail so to do, the Minister may cause the said wharf to be removed and the site so restored, and may recover from the licensees the costs incurred by the said removal and restoration.

  2. The occupation of the wharf shall be deemed to be an acceptance by the licensees of the conditions of this Order in Council.

SECOND SCHEDULE.

Shipping Wharfage.

Every person who shall use the said wharf with any vessel shall pay for the use thereof as follows, that is to say—

For every vessel a sum of 1d. per ton on the gross tonnage of such vessel per day for each day or part of a day a vessel shall occupy a berth alongside the wharf or alongside any vessel lying at the said wharf or shall lie off the said wharf with a line attached thereto.

Goods Wharfage.

Every person who shall use the said wharf for landing or shipping any goods shall, before using same, pay dues as follows, that is to say,—

  1. For all goods landed on the said wharf, a rate of 2s. 6d. per ton weight or measurement, at the option of the licensees.

  2. For every head of great cattle or horses landed upon or shipped from the said wharf, 2s. 6d. per head.

  3. For every yearling or calf so landed upon or shipped from the said wharf, the sum of 1s. per head.

  4. For every head of sheep or small cattle so landed upon or shipped from the said wharf, the sum of 6d. per head.

  5. If any ship shall use the said wharf for the discharge of any goods or cargo after the usual working-hours or on wharf holidays, such ship shall pay to the licensees for the use of the said wharf a charge at the rate of 1s. per ton in addition to the above on all goods or cargo so discharged from such ship.

This charge will be made only when, in the opinion of the wharfinger, it is necessary to employ labour to stack or remove cargo in sheds in consequence of the discharge of such goods or cargo as aforesaid.

Passengers.

For every passenger who shall land on or be shipped from the said wharf, the sum of 1s.

Amendments to the Regulations under the Government Railways Act, 1926.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 8th day of December, 1937.

Present :

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred upon him by the Government Railways Act, 1926, and its amendments, and of all other powers and authorities enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend as from and including the first day of April, one thousand nine hundred and thirty-seven, the regulations made under the Government Railways Act, 1926, on the twenty-first day of January, one thousand nine hundred and thirty, and published in the Gazette of the thirtieth day of January, one thousand nine hundred and thirty, as from time to time amended, in the manner following, that is to say :—

(1) By revoking that portion of the First Schedule to the said regulations relating to Grades 7 and 8 of Subdivision II of the First Division, and substituting in lieu thereof the following :—

(2) By revoking regulation 6 of the Second Schedule to the said regulations and by substituting in lieu thereof the following :—

  1. With respect to members and probationers in Grades 7 and 8 of the First Division the following provisions shall apply :—

(a) No probationer in Grade 8 shall be eligible for advancement beyond subgrade 3 of that grade until he has passed such test of efficiency as may be prescribed by the General Manager.

(b) No member in Grade 8 shall be eligible for advancement to a higher grade until he has passed such further test of efficiency as may be prescribed by the General Manager.

(c) No member in Grade 7 shall be eligible for advancement to a higher grade until he has passed such examination as may be prescribed by the General Manager in subjects relating to the work of the Department; Provided that no member in Grade 7 whose classified salary on the 1st day of April, 1936, was not more than £230 per annum shall be eligible for advancement beyond subgrade 4 of Grade 7 until he has passed the examination referred to in this subparagraph: Provided further that the provisions of this subparagraph shall not apply to any member whose period of service with the Department on the 1st day of June, 1926, amounted to twelve years or more; nor to any member whose position or occupation is such that in the opinion of the General Manager no such examination is necessary.

Appointment of Cemetery Trustees revoked (Roslyn Cemetery).

GALWAY, Governor-General.

IN pursuance and exercise of the powers and authorities vested in me by the Cemeteries Act, 1908, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby revoke a certain Warrant dated the fifteenth day of June, one thousand eight hundred and ninety-two, and published in the Gazette on the twenty-third day of the same month, appointing trustees for the Roslyn Cemetery as described in the Schedule hereto.

SCHEDULE.

ROSlyn CEMETERY.

SECTION 6, Block X, Dunedin and East Taieri District, Otago Land District: Area, 10 acres 0 roods 11 perches, more or less.

As witness the hand of His Excellency the Governor-General, this 29th day of November, 1937.
