Varying the Determinations in respect of the Gisborne Fire Board’s Loan of £13,000.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 24th day of November, 1937.
Present:
THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.
WHEREAS by Order in Council made on the eighteenth day of March, one thousand nine hundred and thirty-seven, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Gisborne Fire Board (hereinafter called “the said local authority”) of the sum of thirteen thousand pounds (£13,000) by a loan to be known as “Reconstruction Loan, 1937” (hereinafter called “the said loan”):
And whereas by Order in Council made on the twenty-third day of April, one thousand nine hundred and thirty-seven, the said determinations were varied to provide for repayment by equal half-yearly instalments of not less than three hundred and seventy-five pounds (£375):
And whereas the authority conferred by the said Orders in Council has not yet been exercised, and it is expedient to again vary certain of the determinations aforesaid in respect of the said loan:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations aforesaid in respect of the said sum by prescribing as follows:—
(1) In lieu of a term not exceeding seventeen and one-half (17½) years the term of the said loan shall not exceed twenty (20) years.
(2) In lieu of repayment by equal half-yearly instalments of not less than three hundred and seventy-five pounds (£375) the said loan shall be repaid by equal aggregate annual or half-yearly instalments of principal and interest over the period as determined in (1) above.

Portion of Walter Street, in the Borough of Takapuna, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 8th day of December, 1937.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Takapuna Borough Council on the twentieth day of October, one thousand nine hundred and thirty-seven, viz.:—
“The Takapuna Borough Council, being the local authority having control of the streets in the Borough of Takapuna, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the portion of Walter Street fronting Lot 33 of Allotment 26, Section 1, Parish of Takapuna”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Walter Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.
THE north-eastern side of all that portion of street, situated in the North Auckland Land District, Borough of Takapuna, known as Walter Street, fronting Lot 33, D.P. 2936, being part Allotment 26, Section 1, Parish of Takapuna. As the same is more particularly delineated on the plan marked P.W.D. 97657, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Portions of Roads in the County of Waikouaiti exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waikouaiti County Council on the twenty-ninth day of October, one thousand nine hundred and thirty-seven, viz.:—
“That the Waikouaiti County Council, being the local authority having the control of the roads in the Waikouaiti County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the portions of the said roads in the said Waikouaiti County fronting Sections 51, 54, 56, 58, 60, and part Sections 48 and 61, Sawyers Bay District”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the portions of roads (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of roads.
SCHEDULE.
THE south-eastern side of all that portion of road, situated in the Otago Land District, County of Waikouaiti, fronting part Section 61, Sawyers Bay Survey District; marked A–B on plan.
Also the western side generally of all that portion of road situated in the said land district and county fronting Sections 51, 54, 56, 58, and 60, and parts Sections 48 and 61, Sawyers Bay Survey District; marked B–C on plan.
As the same are more particularly delineated on the plan marked P.W.D. 97664, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
