The Local Bodies’ Loans Act, 1926, Section 31.—Cancellation of Debentures.—Glen Eden Town Board.
—
WHEREAS by section thirty-one of the Local Bodies’ Loans Act, 1926 (hereinafter referred to as “the said Act”), it is provided that where a local authority has executed any debentures it may, in certain cases, with the precedent consent of the Minister of Finance, cancel those debentures and issue new debentures in lieu thereof:
And whereas the Glen Eden Town Board is desirous of cancelling certain debentures executed by the Town Board (hereinafter referred to as “the said debentures”), namely, debentures numbered one (1) to thirty-five (35) inclusive for one hundred pounds (£100) each totalling three thousand five hundred pounds (£3,500) being the debentures issued in respect of the Glen Eden Town Board Town Hall Loan, 1936, and of issuing new debentures in lieu thereof:
And whereas the said debentures were disposed of by way of hypothecation under section thirty-four of the said Act, and the Bank of New Zealand, to whom the said debentures were so hypothecated, has not disposed of the same under any powers of sale vested in the Bank, and has consented to the cancellation of the same under section thirty-one of the said Act:
Now, therefore, I, Walter Nash, Minister of Finance, acting in exercise of the powers conferred upon me by the said Act, do hereby consent to the cancellation of the said debentures and to the issue of new debentures in lieu thereof.
Dated at Wellington, this 1st day of November, 1937.
W. NASH, Minister of Finance.
