Portion of Warden Street, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 27th day of October, 1937.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the twenty-seventh day of September, one thousand nine hundred and thirty-seven, viz. :—

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of portion of Warden Street abutting on Lot 12, Block I, Township of Opoho ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Warden Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE south-eastern side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Warden Street, fronting Lot 12, Block I, Township of Opoho. As the same is more particularly delineated on the plan marked P.W.D. 97315, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

Portions of Reynolds Street and Leckhampton Court, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the fifth day of July, one thousand nine hundred and thirty-seven, viz. :—

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets, viz. :—

(a) The south-eastern side of portion of Reynolds Street, abutting on Allotment 59 and part Allotment 58, L.T.P. 191, being also part of Section 65, Block VI, Town District ; and

(b) The north-eastern side of portion of Leckhampton Court, abutting on Allotments 56 and 57 and part Allotment 58, L.T.P. 191, being also part of Section 65, Block VI, Town District ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Reynolds Street or the north-eastern side of the portion of Leckhampton Court (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE.

THE south-eastern side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Reynolds Street, fronting Allotment 59, and part Allotment 58, L.T.P. 191.

Also the north-eastern side of all that portion of street in the said land district and city, known as Leckhampton Court, fronting Allotments 56 and 57 and part Allotment 58, L.T.P. 191.

As the same are more particularly delineated on the plan marked P.W.D. 97317, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

(1) “ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-western side of portion of Pacific Street abutting on Allotment 18, Township of Nevada ” ; and

(2) “ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-eastern side of portion of Pacific Street abutting on Allotment 29, Township of Nevada ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western and north-eastern sides of the portions of Pacific Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of street.

SCHEDULE.

THE south-western side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Pacific Street, fronting Allotment 18, Township of Nevada.

Also the north-eastern side of all that portion of the said street, in the said land district and city fronting Allotment 29, Township of Nevada.

As the same are more particularly delineated on the plans marked P.W.D. 97311 and 97189, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.
