Portions of District Road, Moore Street, Abbotsford Road, and Dinmont Street, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.


GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 27th day of October, 1937.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolutions passed by the Dunedin City Council on the eighteenth day of January and the twenty-fourth day of May, one thousand nine hundred and thirty-seven respectively, viz. :

(1) That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets, viz. :

(a) The south-western side of portion of District Road abutting on Lot 16, Block V, Township of Waverley ;

(b) The south-eastern side of portion of Moore Street abutting on Lots 16, 18, 19, 20, 21, and 22, Block V, Township of Waverley ;

(c) The north-western side of portion of Abbotsford Road abutting on Lot 50, Block V, Township of Waverley ;

(2) That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the western side of Dinmont Street, abutting on Lots 16, 17, 49, and 50, Block V, Township of Waverley.

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the portions of District Road, Moore Street, Abbotsford Road, and Dinmont Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of streets.


SCHEDULE.

THE south-western side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as District Road, fronting Lot 16, Block V, Township of Waverley.

Also the south-eastern side of all that portion of street in the said land district and city known as Moore Street, fronting Lots 16, 18, 19, 20, 21, and 22, Block V, Township of Waverley.

Also the north-western side of all that portion of street in the said land district and city known as Abbotsford Road fronting Lot 50, Block V, Township of Waverley.

Also the western side of all that street in the said land district and city known as Dinmont Street, fronting Lots 16, 17, 49, and 50, Block V, Township of Waverley.

As the same are more particularly delineated on the plan marked P.W.D. 97104, deposited in the office of the Minister of Public Works, and thereon coloured red.

Portion of Lawrence Street, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the thirteenth day of September, one thousand nine hundred and thirty-seven, viz. :

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of portion of Lawrence Street abutting on part of Allotment 9, L.T.P. 4395, and part of Allotment 25, Deeds Plan 47, Block I, Township of Richmond Hill ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Lawrence Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.


SCHEDULE.

Portion of a Road, in the County of Clutha, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Clutha County Council on the thirty-first day of August, one thousand nine hundred and thirty-seven, viz. :

“ The Clutha County Council, being the local authority having control of the roads in the Clutha County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of road adjoining L.T.P. 2833, Block LXXIV, Clutha District. ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of road (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of road.


SCHEDULE.

THE western side of all that portion of road, situated in the Otago Land District, County of Clutha, fronting part Section 1 and part Section 622R, Block LXXIV, Clutha Survey District. As the same is more particularly delineated on the plan marked P.W.D. 97064, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
