Portion of McIntosh Road, in the County of Taieri, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 13th day of October, 1937.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General¹ of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Taieri County Council on the third day of September, one thousand nine hundred and thirty-seven, viz. :—

“The Taieri County Council, being the local authority having control of the roads in the Taieri County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of district road, known as McIntosh Road, adjoining Lot 13, L.T.P. 887, Township of Seaview, and other part of Section eight (8), Block I, Otokia Survey District ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side generally of the portion of McIntosh Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

SCHEDULE.

THE southern side generally of all that portion of road, situated in the Otago Land District, County of Taieri, known as McIntosh Road, fronting Lot 13, L.T.P. 887, Township of Seaview, and part Section 8, Block I, Otokia Survey District. As the same is more particularly delineated on the plan marked P.W.D. 97145, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

Vesting the Control of a Scenic Reserve in the Wanganui City Council.

GALWAY, Governor-General.

IN pursuance and exercise of the powers and authorities conferred upon him by section thirteen of the Scenery Preservation Act, 1908 (hereinafter referred to as “the said Act”), His Excellency the Governor-General of the Dominion of New Zealand doth hereby vest the control of the scenic reserve described in the Schedule hereto (being land reserved under the said Act) in the Wanganui City Council, subject to the conditions hereinafter contained, that is to say :—

  1. The period for which the control of the reserve is hereby vested shall be five years from the date hereof, unless the reservation is previously altered or revoked under the said Act.

  2. The said Council shall prepare a report each year ending on the thirty-first day of March, together with a statement of receipts and expenditure, in connection with the said reserve. Such report and statement shall be sent to the Minister charged with the administration of the said Act as soon as possible after the close of the year.

  3. The said Council shall control the said reserve in accordance with the provisions of the said Act and of the regulations made thereunder.

SCHEDULE.

GORDON PARK SCENIC RESERVE.—WELLINGTON LAND DISTRICT.

ALL that area containing 40 acres, more or less, being part Sections 82 and 83, left bank of the Wanganui River, Block II, Ikitara Survey District, and being all the land comprised in Certificate of Title, Vol. 372, folio 2, Wellington Registry.

As witness the hand of His Excellency the Governor-General, this 9th day of October, 1937.

Member appointed to Kirk’s Bush Scenic Board.

GALWAY, Governor-General.

WHEREAS by a Warrant dated the twelfth day of December, one thousand nine hundred and thirty-four, and published in the Gazette of the twentieth day of that month, the control of a certain reserve in the North Auckland Land District, known as the Kirk’s Bush Scenic Reserve, was vested in certain persons therein named, who were by the said Warrant constituted a special Board by the name of the Kirk’s Bush Scenic Board, in pursuance of section thirteen of the Scenery Preservation Act, 1908 : And whereas it is desirable that David John Graham should be appointed a member of the said Board in place of William Charles Wood, who has resigned :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred on him by section thirteen of the Scenery Preservation Act, 1908, and of all other powers and authorities enabling him in this behalf, doth hereby appoint the said David John Graham to be a member of the Kirk’s Bush Scenic Board constituted by the Warrant dated the twelfth day of December, one thousand nine hundred and thirty-four, hereinbefore referred to, in place of the said William Charles Wood.

As witness the hand of His Excellency the Governor-General, this 9th day of October, 1937.

Appointment under Section 55 of the Prisons Act, 1908.

GALWAY Governor-General.

WHEREAS by writing under his hand dated the thirtieth day of November, one thousand nine hundred and twenty-one, and published in the New Zealand Gazette of the eighth day of December, one thousand nine hundred and twenty-one, the Governor-General, in pursuance of the powers in that behalf conferred upon him by section fifty-five of the Prisons Act, 1908, appointed the Public Trustee of the Dominion of New Zealand administrator of the property of all convicts, other than Natives, within the meaning of and so defined by section two of the Native Land Act, 1907 :

And whereas by virtue of the said section fifty-five of the Prisons Act, 1908, the Governor-General is empowered, by writing under his hand, to revoke any such appointment as aforesaid and to make any other appointment in lieu thereof :

And whereas it is now desirable and expedient that the appointment of the Public Trustee as administrator of the estate of Bertram Emil Sixtus, a convict within the meaning of Part III of the said Prisons Act, 1908, shall be revoked, and that in his stead Vernon Lancelot Sixtus be appointed administrator of the estate of the said Bertram Emil Sixtus :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers in that behalf conferred upon him by the said section fifty-five of the Prisons Act, 1908, doth hereby revoke the aforesaid appointment of the Public Trustee, and in lieu thereof doth hereby appoint the said Vernon Lancelot Sixtus to be the administrator of the estate of the said Bertram Emil Sixtus.

As witness the hand of his Excellency the Governor-General at Wellington, this 9th day of October, 1937.
