Extension of the Provisions of the Mortgagors and Lessees Rehabilitation Act, 1936.

ORDER IN COUNCIL.

At the Government House at Wellington, this 27th day of January, 1937.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred upon him by section nine of the Mortgagors and Lessees Rehabilitation Act, 1936, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order as follows:—

  1. This Order in Council may be cited as the Rehabilitation Extension Order, 1937 (No. 2).

  2. The provisions of the Mortgagors and Lessees Rehabilitation Act, 1936, are hereby extended so that the provisions of that Act shall apply to the instruments particularly referred to in the Schedule hereto, as if such instruments were leases within the meaning of the said Act, and as if the royalties or other moneys payable thereunder were rent.

SCHEDULE.

PARTICULAR instruments to which the provisions of the Mortgagors and Lessees Rehabilitation Act, 1936, are hereby applied:—

  1. The Deed and the Memorandum of Lease from Walter Charles Broughton to Renown Collieries, Limited, dated 18th April, 1928, and registered in the Deeds Register Office and the Land Registry Office at Auckland, respectively, under Numbers 385456 and 13603 respectively.

  2. The Deed and the Memorandum of Lease from Thomas Tapp to Renown Collieries, Limited, dated 17th June, 1926, and registered in the Deeds Register Office and the Land Registry Office, respectively, at Auckland, under Numbers 364474 and 12618 respectively.

  3. The Deed of Mortgage and the Memorandum of Mortgage between Renown Collieries, Limited, and Adit Limited, dated 4th December, 1928, and registered in the Deeds Register Office and the Land Registry Office at Auckland, respectively, under Numbers 385667 and 192013 respectively.

  4. Memorandum of Lease from Alexander Wyllie Rodger the younger to Stephen David Mills, dated the 17th day of April, 1920, and registered in the Lands Registry Office at Invercargill under number 6873.

Order in Council consenting to the Raising of a Loan of £9,000 by the Onehunga Borough Council, and prescribing the Conditions thereof.

ORDER IN COUNCIL.

At the Government House at Wellington, this 21st day of January, 1937.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the Onehunga Borough Council (hereinafter called “the said local authority”) proposes pursuant to the terms of a requisition issued under section twenty-two of the Health Act, 1920, to raise the sum of nine thousand pounds (£9,000) by a loan to be known as “Drainage Loan, 1936” (hereinafter called “the said loan”), for the purpose of carrying out drainage and sewerage works within the borough:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said loan for the said purpose up to the amount of nine thousand pounds (£9,000), and in giving such consent doth hereby determine as follows:—

(1) The term for which the said loan or any part thereof may be raised shall not exceed fifteen (15) years.

(2) The rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender or lenders a rate exceeding three pounds ten shillings (£3 10s.) per centum per annum.

(3) (a) The said loan, together with interest thereon, shall be repaid by thirty (30) equal payments of three hundred and fourteen pounds fifteen shillings (£314 15s.), one of such payments to be made at the end of every half-year, commencing from the date on which the said loan is borrowed. Each such half-yearly payment shall be applied first in payment of interest computed at the rate of three pounds ten shillings (£3 10s.) per centum per annum on the amount of the principal for the time being outstanding at the beginning of each half-year and the balance of such half-yearly payment in reduction of principal.

(b) By a payment at the end of the fifteenth year from the date of the borrowing of the said loan of a sum equal to the amount to which the said principal has been reduced in accordance with the preceding paragraph (a) hereof after payment of the aforesaid thirty (30) half-yearly payments.

(4) The payment of such instalments shall be made in New Zealand, and no instalment shall be paid out of loan-moneys.

(5) The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said loan or any part thereof shall not in the aggregate exceed one-half per centum of any amount raised.

(6) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the Amuri County Council (hereinafter called “the said local authority”) proposes, pursuant to the provisions of section three of the Main Highways Amendment Act, 1928, to borrow the sum of seven hundred and twenty-five pounds (£725) by a loan to be known as “Main Highways Loan, 1937” (hereinafter called “the said loan”), for the purpose of meeting the Council’s share of the cost of carrying out second-coat sealing work on the Hurunui Bridge—Red Post portion of the Waipara—Kaikoura via Culverden Main Highway :
