A PROCLAMATION.

IN pursuance and exercise of the powers conferred by section twelve of the Land Act, 1924, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby proclaim as road the land in Whitianga Survey District described in the First Schedule hereto; and also do hereby proclaim as closed the road described in the Second Schedule hereto.

Authorizing the Okarito Harbour Board to Reclaim Land in Okarito Harbour.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 27th day of January, 1936.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS it is provided by the one hundred and sixty-eighth section of the Harbours Act, 1923 (hereinafter called “the said Act”), that the Governor-General may from time to time, by Order in Council, authorize any local authority or Harbour Board to reclaim from the sea areas, not exceeding five acres in extent, in any case where he considers that the reclamation will not affect navigation and is for the benefit of the public:

And whereas by Order in Council dated the twenty-eighth day of August, one thousand nine hundred and thirty-three, and published in the Gazette of the thirty-first day of the same month, at page 2133, the control and management of the harbour of Okarito was, pursuant to the provisions of the Okarito Harbour Act, 1932–33, vested in the Okarito Harbour Company, Limited (hereinafter called “the Board”):

And whereas by the same Order in Council certain provisions of the said Act, including section one hundred and sixty-eight thereof, were applied as if the said company were a Harbour Board within the meaning of the said Act:

And whereas the Board is desirous of reclaiming from the sea certain land in Okarito Harbour, and the said reclamation is of such a nature as aforesaid, and the Board has applied to the Governor-General in Council for an order authorizing the execution of the said harbour-works:

And whereas it has been made to appear to the Governor-General in Council that the proposed work will not be or tend to the injury of navigation, and is for the benefit of the public:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize and empower the Board to reclaim from the sea in Okarito Harbour the area of land shown edged red on plan marked M.D. 7412, and deposited in the office of the Marine Department at Wellington, such reclamation to be carried out and constructed in accordance with plan marked M.D. 7412, subject to the provisions of the said Act.
