Notice pursuant to Section 18 of the Primary Products Marketing Act, 1936, determining that Ownership of Dairy-produce shall pass to the Crown prior to Shipment.
WHEREAS it is provided by section 18 of the Primary Products Marketing Act, 1936, that all dairy-produce to which Part II of the said Act applies that is intended for export shall, as soon as it is placed, with the concurrence of the Department, on board any ship for export from New Zealand, become the property of the Crown in respect of the Government of New Zealand, free and discharged from all right, title, or interest possessed in respect thereof by any other person: Provided that the Minister may, in respect of any such dairy-produce, determine by notice published in the Gazette that the ownership thereof shall pass to the Crown at any specified time prior to shipment:
And whereas it is expedient that the ownership of the dairy-produce mentioned and described in the Schedule hereto (which said dairy-produce is hereinafter referred to as “the said butter and cheese”), being dairy-produce intended for export from New Zealand, shall pass to the Crown in respect of the Government of New Zealand notwithstanding that the said butter and cheese has not been placed upon board any ship for export from New Zealand:
Now, therefore, I, William Lee Martin, the Acting Minister of Marketing, pursuant to the power in that behalf vested in me by section 18 of the Primary Products Marketing Act, 1936, do hereby determine, declare, and give notice that the ownership of the said butter and cheese shall pass to the Crown in respect of the Government of New Zealand as at and from the date hereof, and that the said butter and cheese shall at and from the date hereof become the property of the Crown in respect of the Government of New Zealand free and discharged from all right, title, or interest possessed in respect thereof by any other person.
SCHEDULE.
TWENTY-THREE thousand one hundred and sixty-five (23,165) boxes of butter and one thousand seven hundred and sixty-one (1,761) crates of cheese now situated in the New Zealand Government Dairy-produce Grading Stores at Auckland, being, first, four thousand three hundred and sixty-seven (4,367) boxes of butter graded and allocated by the Acting Director of Marketing for shipment from Auckland on the 14th day of January, 1937, by the S.s. “Taranaki,” secondly, nine thousand nine hundred and sixty-one (9,961) boxes of butter and one thousand seven hundred and sixty-one (1,761) crates of cheese graded and allocated by the Acting Director of Marketing for shipment from Auckland on the 14th day of January, 1937, by the S.s. “Port Alma,” thirdly, eight thousand eight hundred and thirty-seven (8,837) boxes of butter graded and allocated by the Acting Director of Marketing for shipment from Auckland on the 16th day of January, 1937, by the S.s. “Tainui.”
