south-eastern boundary of Section 2, Block I, Katikati North Survey District; thence across that highway, along the south-eastern boundary of Section 2 aforesaid, the crossing of the East Coast Main Trunk Railway, again Section 2, the south-eastern boundary of part Section 5 of aforesaid Block I, and the southern boundary of Waihi No. 5 Block to the place of commencement: save and excepting the Boroughs of Tauranga (Gazette, 1882, page 295) and Te Puke (Gazette, 1935, page 1017), Mount Maunganui Town District (Gazette, 1937, page 449), and the Tauranga Harbour (section 7, Tauranga Harbour Amendment and Foreshore Vesting Act, 1917), which lie within the above-described boundaries.

COUNTY OF OHINEMURI.

All that area in the Auckland Land District, bounded by a line commencing at the Otahu River; thence in a southerly direction generally along the sea-coast to a point (Te Ararimu) in Block I, Katikati North Survey District, where the southern boundary of Waihi No. 5 Block meets the sea; thence in a south-westerly direction generally along the northern boundary of Crown land, the northern side and western extremity of a public road, the south-western boundary of Lot 1 on D.P. 22631, the north-western boundaries of Section 8, Block I, Katikati North Survey District, Ohinemuri No. 17A Nos. 2A, 2B, and 2C Blocks, Sections 6 and 7, Block I aforesaid, the south-western boundary of Section 7 aforesaid, the north-western boundary of Section 3, Block I aforesaid, the crossing of the East Coast Main Trunk Railway, again Section 3 aforesaid and its production across the Waihi-Tauranga Main Highway; thence along the generally southern side of that highway to the northernmost corner of Section 12, Block I, Katikati Survey District; thence along the north-western and south-western boundaries of Section 12 aforesaid, and the generally western boundaries of Section 17, Block I, and Section 31, Block IV, Katikati Survey District; thence along the northern boundaries of Section 11, Block IV aforesaid, Lots 3 and 2 on D.P. 23590, the crossing of a public road, the northern and western boundaries of Lot 1 on D.P. 23590, the generally northern boundaries of Sections 30 and 28, Block IV aforesaid, and the north-eastern boundary of Crown land to the north-western corner of Section 3, Block VII, Aroha Survey District; thence along a right line to Trig. Station 567, Te Aroha; thence due west along a right line to the eastern boundary of the Borough of Waihi; thence along the eastern and northern boundaries of that borough (Gazette, 1917, page 1868) to the centre of Waihou River; thence in a northerly direction generally down the centre of the Waihou River, the Ngahina Canal, and again the Waihou River to its confluence with the Hikutaia River; thence in an easterly direction generally following the Thames County Boundary (Gazette, 1937, page 235); up the middle of the Hikutaia River to the source nearest to the source of the Otahu River, a right line to the said source of the Otahu River, and down the centre of that river to the point of commencement: save and excepting the Boroughs of Waihi (Gazette, 1926, page 3045) and Paeroa (Gazette, 1925, page 570) which lie within the above-described area.

THIRD SCHEDULE.

WAIHI RIDING, COUNTY OF OHINEMURI.

ALL that area in the Auckland Land District, bounded by a line commencing at a point on the northern boundary of Waihi Borough, being the easternmost corner of Section 16, Block XI, Ohinemuri Survey District; thence in a westerly direction along the road forming the north-eastern boundary of Section 16 aforesaid to Walmsleys Creek; thence in a north-easterly direction generally across that road and along the southern and eastern boundaries of Section 11, the south-western and south-eastern boundaries of Section 20, the south-eastern boundary of Section 6, the crossing of a public road, the generally eastern boundary of Section 16 to and across a public road, the generally southern boundaries of Sections 15, 17, and 1 (Uriwha Reserve), all the aforesaid sections being in Block XII, Ohinemuri Survey District, the north-eastern boundary of Section 1 aforesaid, and the south-eastern boundary of Mataora No. 2 Block to the sea; thence in generally south-easterly and south-westerly directions along the Ohinemuri County boundary hereinbefore described to the north-western corner of Section 3, Block VII, Aroha Survey District; thence in a north-easterly direction along the north-western boundary of Section 3 aforesaid and its production to the generally north-eastern boundary of Section 24, Block III, Aroha Survey District; thence in a north-westerly direction generally along the generally north-eastern and north-western boundaries of Section 24 aforesaid, the generally north-eastern boundaries of Sections 37 and 34, the crossing of a public road, Sections 31 and 26, all of Block III aforesaid, and the generally eastern side of a public road to a point in line with the north-eastern boundary of Section 5 of aforesaid Block III; thence along a right line across that road and along the north-eastern boundary of Section 5 aforesaid, the crossing of the Waihi

Gold Mining Company’s transmission-line, again Section 5 aforesaid, and its production to the middle of the Ohinemuri River; thence in a generally north-easterly direction down the centre of that river to the Waihi Borough; thence in a generally easterly and northerly direction along the southern, eastern, and northern boundaries of the Waihi Borough (Gazette, 1926, page 3045) to the point of commencement: save and excepting portion of the Waihi Borough intersecting the above-described area.

Order in Council consenting to the Raising of Portion (£42,000) of the North Auckland Electric-power Board’s Reticulation Loan, 1935, of £267,000.

ORDER IN COUNCIL.

At the Government House at Wellington, this 18th day of May, 1937.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by a poll of ratepayers taken on the eighth day of May, one thousand nine hundred and thirty-five, the North Auckland Electric-power Board (hereinafter called “the said local authority”) was authorized to borrow by way of loan the sum of two hundred and sixty-seven thousand pounds (£267,000) by a loan to be known as “Reticulation Loan, 1935,” for the purpose of purchasing, constructing, and providing electric works as defined in the Electric-power Boards Act, 1925, in order to supply and to extend the supply of electricity within the whole of the North Auckland Electric-power District, including extensions, preliminary expenses, contingencies, incidentals, costs of raising the loan, and payment out of loan-money of interest on the loan for the first year:

And whereas the sum of one hundred and forty-one thousand pounds (£141,000) has been raised:

And whereas the said local authority, being desirous of raising a further portion—forty-two thousand pounds (£42,000) (hereinafter called “the said sum”)—of the said loan, has complied with the provisions of the Local Government Loans Board Act, 1926 (hereinafter called “the said Act”), and it is expedient that the precedent consent of the Governor-General in Council as required by the said Act should be given to the raising of the said sum:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the said Act, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said sum for the said purpose up to the amount of forty-two thousand pounds (£42,000), and in giving such consent doth hereby determine as follows:—

(1) The term for which the said sum or any part thereof may be raised shall not exceed twenty-two and a half (22½) years.

(2) The rate of interest that may be paid in respect of the said sum or any part thereof shall be such as shall not produce to the lender or lenders a rate exceeding three pounds ten shillings (£3 10s.) per centum per annum.

(3) The said sum shall be free of principal repayments for the first two years of the loan.

(4) The said sum or any part thereof together with interest thereon shall thereafter be repaid by equal aggregate annual or half-yearly instalments extending over a period not exceeding twenty and a half (20½) years.

(5) The payment of interest and the payment of such instalments shall be made in New Zealand, and no such instalments or interest after the first year shall be paid out of loan-moneys.

(6) The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said sum or any part thereof shall not in the aggregate exceed one-half per centum of any amount raised.

(7) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.
