THIRD SCHEDULE.

THE electric lines hereinbefore referred to comprise the particular electric lines described hereinafter and also such further electric lines as may hereafter be required within the areas described in paragraphs (a) and (b) hereof for the supplying of electrical energy for consumption within those areas, such particular electric lines and such areas being described as follows :—

(a) That portion of the County of Buller being portions of Section 1, Block XIV, Ngakawau Survey District, Section 3, Block VI, Sections 1, 2, and 3, Block X, Kawatiri Survey District, and Section W. 58, Blocks VI and X, Kawatiri Survey District, and Block XIV, Ngakawau Survey District, and the Township of Denniston; as indicated by distinctive borders coloured brown and blue on plan marked P.W.D. 46249; also that portion of Block VI, Kawatiri Survey District, shown edged blue on plan marked P.W.D. 57351; and

(b) That portion of the County of Buller being principally the Townships of Granity and Millerton as shown bordered blue on plan marked P.W.D. 52760, the transmission-lines and the lines at present erected being shown by means of green lines and yellow lines on plans marked P.W.D. 52760 and P.W.D. 75310, together with an electric line from Millerton to the power-house on the southern bank of Mine Creek situated in Block VI, Ngakawau Survey District, as indicated by a red line on plan marked P.W.D. 61619; and

(c) Transmission-line commencing at the licensee’s power-house at Denniston and proceeding thence in a north-westerly direction generally for a distance of approximately 2¼ miles to Waimangaroa Junction; thence across the Westport-Seddonville Railway line, and generally following the direction of that railway-line north-westerly for a distance of approximately 7 miles; thence again across the Westport-Seddonville Railway and thence to the licensee’s substation at Granity, the same being more particularly shown by means of a yellow line on the plan marked P.W.D. 93209.

Cancelling the Reservation over a Reserve in Town of Kakaramea, Taranaki Land District.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 31st day of March, 1937.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred upon him by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby cancel the reservation for public utility purposes over the land described in the Schedule hereto; and doth hereby declare that the said land, being vested in the Crown, is Crown land available for disposal under the Land Act, 1924.

Domain Board appointed to have Control of the Putorino Domain.

ORDER IN COUNCIL.

At the Government House at Wellington, this 31st day of March, 1937.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by section forty-four of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

Oswald Hugh Orr,
Donald MacMillan,
Ross Lange,
George Mabey,
William Henry Ebbitt,
Albert Ernest Porter, and
Malcolm Alexander Bellerby

to be the Putorino Domain Board, having control of the land described in the Schedule hereto; and doth hereby appoint Saturday, the twenty-fourth day of April, one thousand nine hundred and thirty-seven, at two o’clock p.m., as the time when, and the Putorino Hall, Putorino, as the place where, the first meeting of the Board shall be held.

Licensing Fish Freezers, Limited, to use and occupy a Part of the Foreshore at Half-moon Bay, Stewart Island as a Site for a Fish-freezing Works.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 31st day of March, 1937.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby license and permit Fish Freezers, Limited, of Bluff (hereinafter called “the company,” which term shall include its successors and assigns unless the context requires a different construction), to use and occupy all those parts of the foreshore shown on plan marked M.D. 5162, approved on the first day of April, one thousand nine hundred and twenty, and deposited in the office of the Marine Department at Wellington, for the purpose of the use of the fish-freezing works as shown on the said plan for a term of fourteen years computed from the first day of April, one thousand nine hundred and thirty-four, such license to be held and enjoyed by the company upon and subject to the terms and conditions set forth in the Schedule hereto.


SCHEDULE.

  1. In these conditions the term—

“Foreshore” means such parts of the bed, shore, or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tides:

“Low-water mark” means low-water mark at ordinary spring tides:

“Minister” means the Minister of Marine as defined by the Shipping and Seamen Act, 1908, and includes any officer, person, or authority acting by or under the direction of such Minister.

  1. The concessions and privileges conferred by or under this Order in Council shall extend and apply only to that part of the foreshore necessary for the maintenance of the said fish-freezing works, as shown on the plan marked M.D. 5162, so deposited in the office of the Marine Department as aforesaid.

  2. In consideration of the concessions and privileges granted by this Order in Council, the company shall pay to the Minister the sum of £1, and thereafter an annual sum of £3 in advance, payable on the 1st day of April in each year.

  3. His Majesty or the Governor-General, and all officers in the Government service acting in the execution of their duty, shall at all times have free ingress, passage, and egress into, through, and out of the said fish-freezing works without payment.

  4. The company shall maintain the above-mentioned fish-freezing works in good order and repair, and shall at all times exhibit therefrom and maintain at the company’s own cost suitable and necessary lights for the guidance of vessels; provided that no light shall be exhibited until after it has been approved of by the Minister.
