Amending Orders in Council dated 24th September, 1934, and 22nd June, 1935, vesting the Management of the Wharf at Waitangi, Chatham Islands, in the Chatham Islands County Council.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 18th day of March, 1937.

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

WHEREAS by Orders in Council dated the twenty-fourth day of September, one thousand nine hundred and thirty-four, and the twenty-second day of June, one thousand nine hundred and thirty-five, and published in the Gazette of the twenty-seventh day of September, one thousand nine hundred and thirty-four, at page 3004, and the twenty-seventh day of June, one thousand nine hundred and thirty-five, at page 1761, respectively, the management of the wharf at Waitangi, Chatham Islands, was vested in the Chatham Islands County Council, and regulations were made with respect to, and dues were prescribed for, the use of the said wharf :

And whereas it is desirable to amend the said Orders in Council :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the Harbours Act, 1923, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the hereinbefore-recited Orders in Council by revoking clauses two and six and the Second Schedule of the said Order in Council of the twenty-fourth day of September, one thousand nine hundred and thirty-four, and by revoking the said Order in Council of the twenty-second day of June, one thousand nine hundred and thirty-five, as from the thirty-first day of March, one thousand nine hundred and thirty-seven.

The Eastern Side of Portion of Queen Victoria Street, in the Borough of Motueka, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 18th day of March, 1937.

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Motueka Borough Council on the sixteenth day of February, one thousand nine hundred and thirty-seven, viz. :

“That the Motueka Borough Council, being the local authority having control of the streets in the Borough of Motueka, hereby resolves that the eastern half of Queen Victoria Street facing the western boundary of part Sections 4, 3, and 2 of Section 177, Motueka Original Survey District, Block III, Motueka Survey District, be exempt from section one hundred and twenty-eight of the Public Works Act, 1928 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Queen Victoria Street (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portion of street.

SCHEDULE.

THE eastern side of all that portion of street, situated in the Nelson Land District, Borough of Motueka, known as Queen Victoria Street, fronting part Section 4 of 177, Motueka Original District, Block III, Motueka Survey District. As the same is more particularly delineated on the plan marked P.W.D. 95208, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

IN pursuance and exercise of the powers conferred by section three hundred and fifty-nine of the Land Act, 1924, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby temporarily reserve the lands in the North Auckland, Auckland, Marlborough, Canterbury, and Otago Land Districts described in the Schedule hereunder written for the purposes specified in the said Schedule.
