At the Government Buildings at Wellington, this 5th day of March, 1937.

Present:

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for the purposes of a public school.

SCHEDULE.

APPROXIMATE areas of the pieces of land permitted to be taken:—

Directing the Sale of Land in Block VII, Crookston Survey District, under the Public Works Act, 1928.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 5th day of March, 1937.

Present:

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred upon him by the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct the sale of the land described in the Schedule hereto, such land being no longer required for the public work for which it was acquired.

SCHEDULE.

APPROXIMATE area of the piece of land directed to be sold:
1 rood.
Being part Section 6.

Situated in Block VII, Crookston Survey District (Otago R.D.). (S.O. S.P. 57.)

In the Otago Land District; as the same is more particularly delineated on the plan marked P.W.D. 95150, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

Increasing Borrowing-powers of Auckland Metropolitan Fire Board.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 5th day of March, 1937.

Present:

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

WHEREAS it is provided by section thirty-one of the Fire Brigades Act, 1926 (hereinafter called “the said Act”), that the Governor-General in Council may, on the application of any Fire Board established under the Fire Brigades Act, 1926, extend the powers of that Board to borrow moneys in excess of the limits fixed by the said section:

And whereas application has been made by the Auckland Metropolitan Fire Board for such increase in the borrowing-powers of the said Board as provided by the said section thirty-one, and it is desirable to grant such request:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities vested in him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the powers of the said Board to borrow moneys in excess of the limits fixed by the said section thirty-one are hereby extended, but so as not to exceed the sum of eighty-five thousand pounds: Provided that no moneys as aforesaid shall be borrowed except subject to the provisions of the Fire Brigades Act, 1926, and its amendments.

Validating Proceedings in connection with the Rotorua Borough Municipal Buildings Loan, 1936, of £25,500.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 5th day of March, 1937.

Present:

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

WHEREAS the Rotorua Borough Council lately proceeded to raise a loan of twenty-five thousand five hundred pounds (£25,500) under the Local Bodies’ Loans Act, 1926, by a loan to be known as the Municipal Buildings Loan, 1936, for the purpose of the erection of municipal buildings, comprising Municipal Offices, Concert Hall, Council Chambers, Museum, Library, Municipal Theatre, and all necessary furnishings:

And whereas the proceedings in connection with the said loan are irregular or defective in that—

(a) The notice required under section ten of the Local Bodies’ Loans Act, 1926, although published four times in a newspaper circulating in the district—namely, on the thirtieth day of September, one thousand nine hundred and thirty-six, the third day of October, one thousand nine hundred and thirty-six, the ninth day of October, one thousand nine hundred and thirty-six, and the fourteenth day of October, one thousand nine hundred and thirty-six—was not thereby published once in each week for four successive weeks as required by the said section; and

(b) The first and second publications of the notice aforesaid—namely, those on the thirtieth day of September, one thousand nine hundred and thirty-six, and on the third day of October, one thousand nine hundred and thirty-six—erroneously set forth the sum proposed to be borrowed as twenty-five thousand pounds (£25,000) instead of twenty-five thousand five hundred pounds (£25,500):

And whereas it appears that the ratepayers of the district have not been misled by such irregularities or defects as aforesaid, and it is expedient to validate the same:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and twenty-two of the Local Bodies’ Loans Act, 1926, and of all other powers and authorities enabling him in this behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the proceedings in connection with the said loan shall be valid to all intents and purposes as though the notice mentioned above had been published once in each week for four successive weeks as required by section ten of the Local Bodies’ Loans Act, 1926, and as though the first two publications of such notice had set forth the sum proposed to be borrowed as £25,500:

And that the validity of the proceedings in connection with the said loan or the validity of the security for the said loan shall not be questioned on the ground of such irregularities or defects.
