THE NEW ZEALAND GAZETTE.

Council hereby makes and levies a special rate of two hundred and seventy five hundred and tenths (270/510) of a penny in the pound upon the rateable value (on the basis of the unimproved value) of all rateable property of the district, and that such special rate shall be an annually recurring rate during the currency of such securities, and be payable yearly on the 1st day of April in each and every year until the last maturity date of such securities, being the 1st day of March, 1956, or until all such securities are fully paid off.”

NOTICE is hereby given that the British General Electric Company, Limited, incorporated in New South Wales, and carrying on business in New Zealand, intends at the expiration of three calendar months from the date of the first publication of this notice to cease to have a place of business in New Zealand.

Memorandum to Customers and others.

It has been decided to reconstruct the above company under the provisions of the Companies Act, 1933, and from the date on which the company ceases to carry on business in New Zealand the organization and affairs of the company in New Zealand will be carried on without interruption by a new company under the same name without interruption.

This notice was first published on the 16th day of January, 1936.

PRIVATE ESTATE BILL.

A PRIVATE ESTATE BILL INTITULED “THE WILLIAM GEORGE DAVID BROWN TRUST ACT, 1936.”

NOTICE is hereby given that George Kinniburgh Brown, of No. 55 Glen Road, Kelburn, in the City of Wellington, as executor and trustee of the will and codicil of William George David Brown, of Wellington, Gentleman (deceased), intends to apply by petition to the General Assembly of New Zealand at its next session for the passing of a Private Estate Bill, the short title of which is as above, to effect the following objects:—

(a) To provide that the Board of Trustees referred to in paragraph 4 of the will of the said William George David Brown (deceased) shall consist of—

(i) The person from time to time holding the office of Mayor of the City of Wellington;

(ii) The person from time to time holding the office of Chairman of the Wellington Hospital Board;

(iii) The person from time to time holding the office of trustee of the will;

and to constitute the said Board of Trustees a body corporate with perpetual succession and a common seal.

(b) To make provision for any person temporarily acting as Mayor of the City of Wellington or Chairman of the Wellington Hospital Board to act as a member of the Board of Trustees in certain circumstances.

(c) To make provision for the representation on the Board of Trustees of any corporate trustee of the will.

(d) To make provision in the event of any member of the Board of Trustees declining to act or resigning.

(e) To validate the acts of the Board of Trustees notwithstanding any vacancies or defective appointments.

(f) To confer on the Board of Trustees constituted as provided in the Bill all the powers conferred by the will of the said William George David Brown (deceased) on the Board of Trustees constituted by the said will, and to make provision for the payment of certain moneys by the trustee of the said will and not by the Board of Trustees as provided in the said will.

(g) To make provision for the finality of the resolutions of the Board of Trustees.

Printed copies of the proposed Bill will, on or before the 28th day of February, 1936, be deposited at the office of the Examiner of Petitions for Private Bills, Parliament Buildings, Wellington.

A BILL INTITULED “THE THOMAS GEORGE MACARTHY TRUST ACT (NO. 2), 1936.”

NOTICE is hereby given that the Public Trustee of the Dominion of New Zealand as executor and trustee of the will of Thomas George Macarthy (deceased) intends to present a petition to the General Assembly of New Zealand at the ensuing session for leave to introduce a Private Estate Bill, the short title of which is as above. The objects of the proposed Bill are—

(1) To prohibit the distribution of the capital of the estate of Thomas George Macarthy (deceased).

(2) To provide that the capital of the said estate shall continue to be held on trust to pay and apply the annual rents, income, and profits arising therefrom for such charitable and educational purposes or institutions in the Provincial District of Wellington in such manner and in such shares or to such extent as the Board of Governors shall from time to time direct.

(3) To empower the Board of Governors from time to time to direct that such part of the annual rents, income, and profits as the Board thinks fit shall be set aside and held by the Public Trustee as a special Building Replacement Fund.

(4) To empower the Public Trustee from time to time to apply the whole or any part of the special Building Replacement Fund to the replacement of any building or buildings owned by the estate which in the opinion of the Public Trustee should be replaced, or in effecting such improvements to buildings as cannot properly be charged to income.

Printed copies of the proposed Bill will be deposited in the Private Bill Office not later than fourteen days after the commencement of the session.

TAURANGA COUNTY COUNCIL.

Tauranga County Loans Conversion Order, 1935 (No. 1).

I, GEORGE HERBERT MENDS, Chairman of the Tauranga County Council, do hereby certify, pursuant to the provisions of subsection (2) of section 9 of the Local Authorities Interest Reduction and Loans Conversion Act, 1932–33, and clause 4 of the Tauranga County Loans Conversion Order, 1935 (No. 1), that the following resolution was duly passed at a special meeting of the Tauranga County Council convened for the purpose and held on the 13th day of December, 1935, and confirmed at the ordinary monthly meeting of the said Council held on the 10th day of January, 1936, and that public notice of the place and date of the confirming meeting and the purport of the said resolution was published in the Bay of Plenty Times newspaper at Tauranga on the 23rd day of December, 1935, and in the Te Puke Times newspaper at Te Puke on the 31st day of December, 1935:—

“That, pursuant to Part II of the Local Authorities Interest Reduction and Loans Conversion Act, 1932–33, and the Tauranga County Loans Conversion Order, 1935 (No. 1), the Tauranga County Council resolves to issue new securities in conversion of the existing securities issued in respect of the loans set out in the First Schedule of the aforementioned Order on the terms and conditions set out in that Order.”
