Authorizing the Laying-off of a Street in the Borough of Napier, between Taradale Road and Kennedy Road, of a Width less than 66 ft., but not less than 60 ft., subject to a Condition as to the Building-line.

At the Government House at Wellington, this 27th day of January, 1936.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1928, the Municipal Corporations Act, 1933, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Napier Borough Council to permit the laying-off of the proposed street described in the Schedule hereto of a width less than sixty-six feet, but not less than sixty feet, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the said street within a distance of thirty-five feet from the centre-line of the said street.

SCHEDULE.

That proposed street in the Hawke’s Bay Land District, Borough of Napier, between Taradale Road and Kennedy Road, containing by admeasurement 3 acres 1 rood 3·4 perches, more or less, being portion of parts Lot 3, D.P. 6187, being part Te Whare-O-Maraenui Block. As the same is more particularly delineated on the plan marked P.W.D. 90429, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Western Side of Portion of Queen Victoria Street, and the Eastern Side of Portion of Chamberlain Street, in the Borough of Motueka, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 27th day of January, 1936.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Motueka Borough Council on the third day of December, one thousand nine hundred and thirty-five, viz. :—

“ That the Motueka Borough Council, being the local authority having control of the streets in the Borough of Motueka, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928; shall not apply to the western side of the portion of Queen Victoria Street or to the eastern side of the portion of Chamberlain Street fronting parts Sections 192 (N.R.) and 208 (N.R.) respectively, Motueka Original District, Block III, Motueka Survey District ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Queen Victoria Street, or on the land fronting the eastern side of the portion of Chamberlain Street, described in the Schedule hereto, within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE.

THE western side of all that portion of street, situated in the Nelson Land District, Borough of Motueka, known as Queen Victoria Street, fronting part Section 192 (N.R.), Motueka Original District, Block III, Motueka Survey District.

Also the eastern side of all that portion of street, situated in the said land district and borough, known as Chamberlain Street, fronting part Section 208 (N.R.), Motueka Original District, Block III, Motueka Survey District.

As the same are more particularly delineated on the plan marked P.W.D. 90794, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The South-eastern and South-western Sides of Portions of Kerry Street, in the Borough of Alexandra, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 27th day of January, 1936.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Alexandra Borough Council on the second day of December, one thousand nine hundred and thirty-five, viz. :—

“ The Corporation of the Mayor, Councillors, and Burgesses of the Borough of Alexandra, being the local authority having control of the streets in the Town of Alexandra, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to portion of the street known as Kerry Street adjoining Sections one (1), two (2), and three (3), Block forty-two, Town of Alexandra (part of the land in Certificates of Title, Volume 187, folios 92 and 93) ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern and south-western sides of the portions of Kerry Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of street.

SCHEDULE.

THE south-eastern and south-western sides of all those portions of street, situated in the Otago Land District, Borough of Alexandra, known as Kerry Street, fronting Sections 1, 2, and 3, Block XLII, Town of Alexandra. As the same are more particularly delineated on the plan marked P.W.D. 91143, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
