the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
doth hereby authorize the Christchurch City Council to permit
the laying-off of the proposed street described in the Schedule
hereto of a width less than sixty-six feet but not less than
forty-nine feet six inches, subject to the condition that no
building or part of a building shall at any time be erected on
the land fronting either side of the said street within a distance
of thirty-five feet from the centre-line of the said street,
provided, however, that this condition shall not apply to
Lot 17, D.P. 272, and Lots 14 to 20 (inclusive), D.P. 2421.

THAT proposed street, in the Canterbury Land District, City
of Christchurch, connecting Flockton Street and Shirley Road,
and comprising the following areas :—

Portions of Roads in the County of Takaka exempted from the
Provisions of Section 128 of the Public Works Act, 1928,
subject to a Condition as to the Building-line.

GALWAY, Governor-General.
ORDER IN COUNCIL.

At the Government House at Wellington, this 9th day of
December, 1936.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in any-
wise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting by
and with the advice and consent of the Executive Council of
the said Dominion, doth hereby approve of the following
resolutions passed by the Takaka County Council on the
sixth day of October, one thousand nine hundred and thirty-
six, viz. :—

(1) “The Takaka County Council, being the local
authority having control of the roads of the Takaka County,
by resolution declares that the provisions of section one
hundred and twenty-eight of the Public Works Act, 1928,
shall not apply to the south-eastern side of the road on the
north-western side of part Section 163, Takaka District,
Block X, Waitapu Survey District, and to the north-
eastern side of the road on the south-western side of the
said section”;

(2) “The Takaka County Council, being the local
authority having control of the roads of the Takaka County,
by resolution declares that the provisions of section one
hundred and twenty-eight of the Public Works Act, 1928,
shall not apply to the south-eastern side of the road on the
north-western side of part Section 29, Takaka District,
Block X, Waitapu Survey District”;

(3) “The Takaka County Council, being the local
authority having control of the roads of the Takaka County,
by resolution declares that the provisions of section one
hundred and twenty-eight of the Public Works Act, 1928,
shall not apply to the north-western side of the road on the
south-eastern side of part Sections 131 and 132, Takaka
District, Block X, Waitapu Survey District, and to the
south-eastern side of the road on the north-western boundary
of part Section 131, and to the road passing through the
said Section 131, and to the eastern side of the road passing
through Section 21, Takaka District, Block X, Waitapu
Survey District”;

subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the said
portions of roads (described in the Schedule hereto) within a
distance of thirty-three feet from the centre-lines of the said
portions of roads.

THE south-eastern side of all that portion of road in the Nelson
Land District, County of Takaka, fronting part Section 163,
Takaka District, Block X, Waitapu Survey District ; shown

Also the north-eastern side of all that portion of road in
the said land district and county, fronting part Section 163,
Takaka District, Block X, Waitapu Survey District ; shown

The Northern Side of Portion of Sylvan Avenue, in the Borough
of Mount Eden, exempted from the Provisions of Section 128 of
the Public Works Act, 1928, subject to a Condition as to the
Building-line.

ORDER IN COUNCIL.

passed by the Mount Eden Borough Council on the twenty-
seventh day of October, one thousand nine hundred and
thirty-six, viz. :—

“ That the provisions of section one hundred and twenty-
eight of the Public Works Act, 1928, shall not apply to that
portion of Sylvan Avenue fronting Lots 14, 15, and part 16
of Allotment 1, Section 10, Suburbs of Auckland, as is more
particularly delineated on the accompanying plans ”;

subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the northern
side of the portion of Sylvan Avenue (described in the Schedule
hereto) within a distance of thirty-three feet from the centre-
line of the said portion of street.

SCHEDULE.

THE northern side of all that portion of street, situated in the
North Auckland Land District, Borough of Mount Eden,
known as Sylvan Avenue, fronting Lots 14 and 15 and part
Lot 16, D.P. 1252, being part of Allotment 1, Section 10,
Suburbs of Auckland. As the same is more particularly
delineated on the plan marked P.W.D. 94179, deposited in
the office of the Minister of Public Works at Wellington, and
thereon coloured red.
