Directing Sale of Railway Land at Tokarahi under the Public Works Act, 1928.
GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 26th day of August, 1936.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by the thirty-fifth section of the Public Works Act, 1928 (hereinafter termed “the said Act”), it is enacted that if it is found that any land held, taken, purchased, or acquired at any time under this or any other Act or Provincial Ordinance, or otherwise howsoever, for any public work, is not required for such public work, the Governor-General may, by Order in Council publicly notified and gazetted, cause the same to be sold under the conditions set forth in the said Act:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and direct the sale of the said land described in the Schedule hereto.
SCHEDULE.
APPROXIMATE area of the piece of land: 1 acre 2 roods 18 perches
Portion of railway land (part Section 3 and part closed road), Block VIII, Maruwenua Survey District, Waitaki County (S.O.P. M 143.)
In the Otago Land District; as the same is more particularly delineated on the plan marked L.O. 4292, deposited in the Office of the Minister of Railways at Wellington, and thereon coloured violet.

Directing the Sale of Land in Block XI, Puniu Survey District, under the Public Works Act, 1928.

ORDER IN COUNCIL.
At the Government House at Wellington, this 2nd day of September, 1936.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers and authorities conferred upon him by the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct the sale of the land described in the Schedule hereto, such land being no longer required for the public work for which it was taken.
SCHEDULE.
APPROXIMATE area of the piece of land directed to be sold: 9 acres 3 roods 16 perches.
Being portion of Tokanui 1p 2 Block.
Situated in Block XI, Puniu Survey District (Auckland R.D.). (S.O. 28638.)
In the Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 93202, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The North-eastern Side of Portion of Antrim Street, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 2nd day of September, 1936.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Majesty the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the eleventh day of May, one thousand nine hundred and thirty-six, viz. :—
“That that the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to portion of the north-eastern side of Antrim Street in the said City of Dunedin where such portion of street abuts on Allotments 45 and 46, Township of Normanby, being also part of Section 40, North-east Valley Survey District, as the said portion of street is more particularly shown on the plan annexed hereto and is thereon coloured red ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Antrim Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
THE north-eastern side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Antrim Street, fronting Allotments 45 and 46, Township of Normanby, being part Section 40, North-east Valley Survey District. As the same is more particularly delineated on the plan marked P.W.D. 93067, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The North-eastern Side of Portion of Haybittle Street, in the Borough of Feilding, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.
GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 2nd day of September, 1936.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Feilding Borough Council on the ninth day of July, one thousand nine hundred and thirty-six, in so far as it affects the portion of street described in the Schedule hereto, viz. :—
“That that the Feilding Borough Council now declares in terms of the proviso thereto that the provisions of subsection one of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to any part of Haybittle Street, in the Borough of Feilding ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Haybittle Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
