in so far as it affects the portion of street described in the Schedule hereto, viz.:

"That the Motueka Borough Council, being the local authority having control of the streets within the Borough of Motueka, hereby declares that section one hundred and twenty-eight, Public Works Act, 1928, shall not apply to the southern half of King Edward Street fronting the northern boundary of Section 3 of Section 177, Block III, Motueka Survey District";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of King Edward Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

The southern side of all that portion of street, situated in the Nelson Land District, Borough of Motueka, known as King Edward Street, fronting part Section 3 of 177, Motueka Original District, Block III, Motueka Survey District. As the same is more particularly delineated on the plan marked P.W.D. 92248, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The South-eastern Side of Portion of Bruce Street, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 3rd day of June, 1936.

Present:

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the eleventh day of May, one thousand nine hundred and thirty-six, viz.:

"That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to portion of the south-eastern side of Bruce Street in the said City of Dunedin where such portion of street abuts on Allotment 9, Block I, Township of Roslyn, being also part of Section 28, Block IV, Upper Kaikorai District, as the said portion of street is more particularly shown on the plan annexed hereto and is thereon coloured red to its centre-line";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Bruce Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

The south-eastern side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Bruce Street, fronting Allotment 9, Block I, Township of Roslyn, being part Section 28, Block IV, Upper Kaikorai Survey District. As the same is more particularly delineated on the plan marked P.W.D. 92310, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Reimposing Protection on Californian Quail (Callipepla Californica) in the County of Murchison.

GALWAY, Governor-General.

IN pursuance of the powers vested in me by the Animals Protection and Game Act, 1921-22 (hereinafter referred to as “the said Act”), I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby declare that as on and from the first day of August, one thousand nine hundred and thirty-six, Californian quail (Callipepla californica) shall be deemed to be included in the Second Schedule of the said Act with respect to that portion of the Nelson Acclimatization District comprising the County of Murchison.

As witness the hand of His Excellency the Governor-General, this 6th day of June, 1936.
