HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for the purposes of a secondary school.

APPROXIMATE area of the piece of land permitted to be taken: 10 acres.
Being Lots 1 and 2, D.P. 15722, being portion of Allotment 17 of Section 12, Suburbs of Auckland.
Situated in Block I, Otahuhu Survey District (One Tree Hill Borough), (Auckland R.D.). (S.O. 28351.)
In the North Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 91563, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured yellow.

IN pursuance and exercise of the powers conferred by section forty-four of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

G. Gibbs, 159 Collingwood Street, Nelson, as the place where, the first meeting of the Board shall be held.

ORDER IN COUNCIL.
At the Government House at Wellington, this 20th day of May, 1936.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by Order in Council dated the tenth day of April, one thousand nine hundred and twenty-two, and published in the Gazette of the thirteenth day of the same month, at page 1035, William Henry Saies (hereinafter referred to as “the licensee”) was licensed to use and occupy a part of the foreshore at Totara North, Whangaroa Harbour, as shown on plan marked M.D. 1930, and deposited in the office of the Marine Department at Wellington, in order to erect and maintain thereon buildings for storing purposes, as shown on the said plan so deposited as aforesaid, for the term of fourteen years computed from the twenty-eighth day of March, one thousand nine hundred and twenty-two, on the terms and conditions therein expressed:
And whereas the licensee has applied for a fresh license under the Harbours Act, 1923 (hereinafter called “the said Act”), for a further term of fourteen years, and it is advisable to grant the same:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the purpose or object for which the said license is required by the licensee as aforesaid; and, in further pursuance and exercise of the said power and authority, and with the like advice and consent as aforesaid, doth hereby license and permit the licensee to use and occupy that part of the foreshore which is particularly shown and delineated on the plan so deposited as aforesaid, for the purpose of using the said buildings in connection therewith, such license to be held and enjoyed by the licensee upon and subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE.
I. In these conditions the term—
“Foreshore” means such parts of the bed, shore, or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tides:
“Low-water mark” means low-water mark at ordinary spring tides:
“Minister” means the Minister of Marine as defined by the Shipping and Seamen Act, 1908, and includes any officer, person, or authority acting by or under the direction of such Minister.

The concessions and privileges conferred by or under this Order in Council shall extend and apply only to that part of the foreshore necessary for the maintenance of the said buildings, as shown on the plan marked M.D. 1930, so deposited in the office of the Marine Department as aforesaid.

In consideration of the concessions and privileges granted by this Order in Council, the licensee shall pay to the Minister the sum of £1, and thereafter an annual
