Mill Lane (or Road), in the Town District of Warkworth, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 7th day of February, 1936.
Present:
THE HON. M. J. SAVAGE PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Warkworth Town Board on the twenty-first day of October, one thousand nine hundred and thirty-five, viz. :—
“ That the Warkworth Town Board, being the local authority having control of the streets in the Town District of Warkworth, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that street known as Mill Road (otherwise known as Mill Lane) adjoining parts of Allotment 67, Parish of Mahurangi ” ;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting either side of Mill Lane (or Road) (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said street.

SCHEDULE.
ALL that street, situated in the North Auckland Land District, Town District of Warkworth, known as Mill Lane (or Road), extending from Queen Street to Neville Street. As the same is more particularly delineated on the plan marked P.W.D. 91194, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Portions of Roads in the County of Waimea exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waimea County Council on the eighth day of November, one thousand nine hundred and thirty-five, viz. :—
“ That the Waimea County Council, being the local authority having control of the roads within the Waimea County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the following roads, namely,—
“ (1) To the southern side of the road on the northern boundary of part Section III, Block VII, Motueka S.D., for a distance of 1025 links in a westerly direction from the western boundary of part Section II, Block VII, Motueka, as shown on plan prepared by F. A. C. Staig, Surveyor, and coloured red thereon.
“ (2) To the eastern side of the road on the western boundary of part Section 64, Block X, Kaiteriteri S.D., for a distance of 919·7 links in a southerly direction from the northern boundary of the said part Section 64, as shown on plan prepared by F. A. C. Staig, Surveyor, and coloured red thereon.
“ (3) To the southern side of the road on the northern boundary of parts Section 64 and part Section 63, Block X, Kaiteriteri, for a distance of 779 and 724·1 links in an easterly direction from the western boundary of Section 64, Block X, Kaiteriteri S.D., as shown on plan prepared by F. A. C. Staig, Surveyor, and coloured red thereon.
“ (4) To the western side of the road on the eastern boundary of that part of Section 110, Block VI, Waimea S.D., between the railway reserve and the Nelson-Westport Coast Main Highway, as shown on plan prepared by F. I. Ledger, Surveyor, and coloured red thereon ; neither shall the said section one hundred and twenty-eight of the Public Works Act, 1928, apply to the northern side of the road on the southern boundary of Section 110, Block VI, Waimea S.D., as shown on plan prepared by F. I. Ledger, Registered Surveyor, and coloured red thereon ” ;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the portions of roads (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portions of roads.

SCHEDULE.
THE southern side of all that portion of road, situated in the Nelson Land District, County of Waimea, fronting part Section III, Moutere District, Block VII, Motueka Survey District ; marked A–B on plan P.W.D. 90810.
Also the eastern side of all that portion of road in the said land district and county, fronting Lot 1, D.P. 1184, being parts Sections 63 and 64, Motueka Original District, Block X, Kaiteriteri Survey District ; marked A–B on plan P.W.D. 90811.
Also the northern side of all those portions of road in the said land district and county, fronting Lot 1, D.P. 1184, being parts Sections 63 and 64, Motueka Original District, Block X, Kaiteriteri Survey District ; marked B–C and D–E on plan P.W.D. 90811.
Also the south-western side of all that portion of road in the said land district and county, fronting part Section 110, Waimea East, Block VI, Waimea Survey District ; marked A–B on plan P.W.D. 90812.
Also the north-western side of all that portion of road in the said land district and county, fronting part Section 110, Waimea East, Block VI, Waimea Survey District ; marked B–C on plan P.W.D. 90812.
As the said portions of roads are more particularly delineated on the plans marked as above mentioned, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

“ That the Motueka Borough Council, being the local authority having control of the streets in the Borough of Motueka, by resolution declares that the provisions of section one hundred and twenty-eight, Public Works Act, 1928, shall not apply to that portion of the eastern side of Atkins Street fronting part Section 185 from Poole Street to Parker Street, and that portion of the southern side of Parker Street fronting on to part Section 185 a distance of 500 links, and that portion of the northern side of Poole Street fronting part Section 185 a distance of 500 links marked red on the accompanying plan, Motueka Original District, Block III, Motueka Survey District ” ;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Poole Street, or the eastern side of the portion of Atkins Street, or the southern side of the portion of Parker Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of streets.
