The North-eastern Side of Portion of Isadore Road, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 23rd day of January, 1935.
Present:
His Excellency the Governor-General in Council.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the fifth day of December, one thousand nine hundred and thirty-four, viz. :
“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to portion of the north-eastern side of Isadore Road, in the said City of Dunedin, where such portion of street abuts on Allotments 1, 2, 3, 4, 5, 6, 7, and 8, L.T.P. 2244, part Township of St. Clair Park, being also part of Sections 25 and 26, Ocean Beach District, as the said portion of street is more particularly shown on the plan annexed hereto and is thereon coloured red to its centre-line ” ;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Isadore Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
THE north-eastern side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Isadore Road, fronting Allotments 1 to 8, L.T. plan 2244, part Township of St. Clair Park, being also part of Sections 25 and 26, Ocean Beach District. As the said portion of street is more particularly delineated on the plan marked P.W.D. 88800, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

“ That the Waimea County Council, being the local authority having control of the roads in the Waimea County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the Main Road adjoining part of Section 83, “ Waimea South,” Block XII, Wai-iti Survey District, marked A–B and coloured red on plan ” ;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

THE north-western side of all that portion of road, situated in the Nelson Land District, County of Waimea, known as Main Road, fronting part Section 83, “ Waimea South,” Block XII, Wai-iti Survey District. As the said portion of road is more particularly delineated on the plan marked P.W.D. 88766, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The South-western Side of Portion of Caledonian Road, in the Borough of Oamaru, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Oamaru Borough Council on the fourth day of October, one thousand nine hundred and thirty-four, viz. :
“ That the Oamaru Borough Council, being the local authority having control of the streets in the Borough of Oamaru, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of street known as Caledonian Road, adjoining part of Section 7, Block I, on the public maps of the Oamaru District ” ;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.

As the said portion of street is more particularly delineated on the plan marked P.W.D. 88585, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
