Radio (Cook Islands Amendment) Regulations, 1934.

ORDER IN COUNCIL.

At the Government House at Wellington, this 23rd day of January, 1935.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, and by virtue of the Post and Telegraph Act, 1928, the Cook Islands Act, 1915, and of all other powers and authorities enabling him in that behalf, doth hereby make the following regulations.

REGULATIONS.

  1. These regulations may be cited as the Radio (Cook Islands Amendment) Regulations, 1934.

  2. These regulations shall be read together with and be deemed to form part of the Radio Regulations, 1932 (hereinafter called “the principal regulations”).

  3. These regulations shall come into force on the date of their publication in the New Zealand Gazette.

  4. The Cook Islands Amateur Radio Regulations, 1925, published in the New Zealand Gazette of the 11th day of June, 1925, are hereby revoked, but all licenses issued and in force thereunder shall remain in force and shall be deemed to be licenses issued under the corresponding provisions of the principal regulations as hereby amended.

  5. The principal regulations are hereby amended by revoking clause (b) of Regulation 1 thereof, and substituting the following clauses:—

“(b) These regulations shall not apply to the Territory of Western Samoa.

“(c) The following provisions of these regulations shall not apply to the Cook Islands:—

“Parts III, IV, and V, Section B of Part VI, and Part VII relating respectively to mobile stations, broadcasting stations, private commercial stations, private experimental (research) stations, and radio dealers, and comprising Regulations Nos. 74 to 154 (inclusive) and 176 to 213 (inclusive).

“(d) The provisions of clause 73 of Part II of the principal regulations shall not apply to the Island of Niue, for which territory the fees, if any, shall be as prescribed from time to time by the Minister of External Affairs.”

  1. Regulation 6 of the principal regulations is hereby amended by adding thereto the following words: “For the purposes of these regulations the Cook Islands shall be a Radio District classified as follows:—

“(5) Cook Islands.”

  1. The principal regulations are further amended by adding thereto the following provisions:—

“PART IX.—COOK ISLANDS.

“214. In the application of these regulations to the Cook Islands and also (so far as applicable) in the application to the Cook Islands of sections 199 to 201 (inclusive) of the Post and Telegraph Act, 1928—

“(i) All references to the Minister of Telegraphs shall, save as provided by Regulation No. 216 hereof, be construed as references to the Resident Commissioner of Rarotonga, or the Resident Commissioner of Niue, as the case may require, and all powers, discretions, and duties conferred or imposed on the Minister of Telegraphs shall be exercised and discharged by such Resident Commissioner.
