- The diagrams appended hereto may be referred to for interpretation of any of the provisions hereinafter contained.
Revocation.
- The General Harbour Regulations made by Order in Council on the 17th day of May, 1927, and published in the Gazette on the 19th day of the same month, at page 1475, shall be revoked upon the coming into force of these regulations.
PART II.—EXEMPTION.
Persons not relieved from Responsibility.
- No maker of or dealer in cargo gear and no shipowner or other person shall by reason of these regulations or of anything done hereunder be relieved from any responsibility in respect of any cargo gear made, sold, or used by him to which but for these regulations he would have been subject.
Gear in use before 17th May, 1927.
- Except as hereinafter mentioned the requirements of these regulations relating to the testing of chains and ropes shall not apply to chain or rope which has been used for working cargo before the 17th day of May, 1927 :
Provided that the provisions of Part X hereof, and Regulations 63, 64, 69, and 70 hereof, shall apply to such chain and rope respectively in all respects.
Gear in use before Commencement.
- Except as hereinafter mentioned the requirements of these regulations relating to the testing of chains and ropes shall not apply to chain or rope which before the coming into force of these regulations is in stock in any place in New Zealand or in use for working cargo if such chain or rope has already been tested in accordance with the requirements of the regulations hereby revoked :
Provided that the provisions of Part X hereof, and Regulations 63, 64, 69, and 70 hereof, shall apply to such chain or rope respectively in all respects.
Gear complying with Overseas Regulations.
- The cargo gear of a ship which has been inspected under and complies with the provisions of the Docks Regulations of the United Kingdom, or with the regulations of any country the Government of which has enacted regulations for cargo gear substantially equivalent to these regulations shall be deemed to comply with the requirements of these regulations :
Provided that nothing in this regulation shall exempt any person using such cargo gear from compliance with the regulations contained in Part V hereof.
Gear of other Overseas Ships.
- The cargo gear of a ship not provided for by the last preceding regulation shall on the occasion of the first visit of the ship to New Zealand be deemed to comply with the requirements of these regulations upon the following conditions :—
(a) All cargo gear thereof shall have been closely examined by responsible ship’s officers within the six months immediately preceding the arrival of the ship in New Zealand :
(b) A statement shall be drawn up by the ship’s officers who made the inspection, and signed by the master specifying the gear inspected and date or respective dates of inspection and declaring that the cargo gear is in good condition and that the respective parts thereof are fit for the working of any cargo for which such parts may reasonably be required :
(c) The said statement shall be available for inspection and endorsement by any Surveyor of Ships or Inspector of Gear at any port at which such ship loads or unloads cargo :
Provided that nothing in this regulation shall exempt any person using such cargo gear from compliance with the regulations contained in Part V hereof :
Provided also that nothing in this regulation shall apply so as to exempt from full compliance with these regulations the cargo gear of any ship on the occasion of the second or any subsequent visit of the ship to New Zealand.
