Modifying Tariff Agreement with the Commonwealth of Australia.—(C. No. 134.)

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 29th day of May, 1935.

Present:

THE HONOURABLE E. A. RANSOM PRESIDING IN COUNCIL.

WHEREAS by section ten of the Customs Amendment Act, 1921, it is enacted that the powers conferred on the Governor-General by section eight thereof shall be exercisable for the purpose of giving effect to any agreement or arrangement entered into by or on behalf of the Government of New Zealand with the Government of any other country for the purpose of promoting trade between those countries, and it is thereby further enacted that no such agreement or arrangement shall have any effect unless and until it is ratified by Parliament:

And whereas by the Trade Agreement (New Zealand and Australia) Ratification Act, 1933, a certain reciprocal Customs agreement with the Commonwealth of Australia (hereinafter called “the said agreement”), being an agreement to which section ten of the Customs Amendment Act, 1921, applies, was ratified:

And whereas by subsection two of section two of the Trade Agreement (New Zealand and Australia) Ratification Act, 1933, it is enacted that, notwithstanding anything to the contrary in section ten of the Customs Amendment Act, 1921, any agreement modifying the said agreement may be given effect to by Order in Council under that Act notwithstanding that such modifying agreement may not have been ratified as required by that section:

And whereas by section three of the Trade Agreement (New Zealand and Australia) Ratification Act, 1933, it is provided that the date on which the said agreement is brought into force shall be notified by the Governor-General by Proclamation; and accordingly by a Proclamation made on the twenty-eighth day of November, one thousand nine hundred and thirty-three, and published in the New Zealand Gazette on the thirtieth day of the same month, at page 3155, it was notified that the said agreement should come into force on the first day of December, one thousand nine hundred and thirty-three:

And whereas His Majesty’s Government in the Commonwealth of Australia and His Majesty’s Government in the Dominion of New Zealand have agreed to a modification of the said agreement, and it is expedient that effect should be given to such modification in manner hereinafter appearing:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers particularly conferred on him by sections eight and twelve of the Customs Amendment Act, 1921, and section two of the Trade Agreement (New Zealand and Australia) Ratification Act, 1933, and of all other powers enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby suspend the existing tariff (being the First Schedule to the Customs Acts Amendment Act, 1934) in so far as it relates to such goods, being the produce or manufacture of the Commonwealth of Australia, as are set out in Column No. 2 of the Schedule hereto, and in lieu thereof doth hereby impose on those classes of goods the duties of Customs set forth in Column No. 3 of that Schedule; and doth hereby further declare that all duties of Customs that have become due and payable, and all penalties and forfeitures that have been incurred prior to the coming into force of this Order in Council, shall be recovered as if this Order in Council had not been made:

And with the like advice and consent doth hereby declare that this Order in Council shall come into force on the first day of June, one thousand nine hundred and thirty-five.

Vesting a Reserve in the Rangitikei County Council.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 21st day of May, 1935.

Present:

THE HONOURABLE E. A. RANSOM PRESIDING IN COUNCIL.

WHEREAS the land described in the Schedule hereto has been duly set apart for river-protection purposes:

And whereas, in the opinion of the Governor-General, it is expedient to vest the said reserve in the Chairman, Councillors, and Inhabitants of the County of Rangitikei:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section nine of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that, from and after the day of the date hereof, the reserve described in the Schedule hereto shall become vested in the Chairman, Councillors, and Inhabitants of the County of Rangitikei, in trust, for river-protection purposes.

WELLINGTON LAND DISTRICT.

SECTION 72, Block XV, Rangitoto Survey District: Area, 11 acres 1 rood 15 perches, more or less.
