order, and good government of Samoa conferred upon him by
the Samoa Act, 1921, and of all other powers and authorities
enabling him in that behalf, doth hereby make the following
regulations.

REGULATIONS.

  1. This Order may be cited as the Samoa Immigration
    Amendment Order, 1935, and shall be read together with and
    be deemed to form part of the Samoa Immigration Order,
    1930 (herein referred to as “the said Order”).

  2. This Order shall come into force on the 1st day of April,

  3. Clause 4 of the said Order is hereby amended—
    (a) By deleting from paragraph (a) of subclause (1) thereof
    the words “other than a person of British birth and
    parentage unless he is,” and substituting the following
    words “who is not.”
    (b) By revoking subclause (2) thereof:
    (c) By deleting from subclause (7) thereof the words “to
    a Samoan.”

  4. Clause 6 of the said Order is hereby amended by deleting
    from the heading thereof the words “to foreigners.”

  5. Clause 17 of the said Order is hereby amended—
    (a) By inserting after the word “labourer” wherever it
    occurs the words “domestic servant or artisan.”
    (b) By inserting after the word “labourers” in subclause (1)
    thereof the words “domestic servants or artisans.”
    (c) By adding the following additional subclause :—
    “ (3) Any such labourer, domestic servant, or
    artisan who fails to leave Samoa when ordered to do
    so by the Administrator in pursuance of this clause
    shall be guilty of an offence and shall be liable to a
    fine of £100 or to imprisonment for six months.”

  6. Clause 18 of the said Order is hereby amended by revoking
    paragraph (a) thereof.

  7. Clause 19 of the said Order is hereby amended by deleting
    the word “two,” and substituting the word “five.”

The Southern Side of Portion of Seine Street, in the City of
Wellington, exempted from the Provisions of Section 128 of
the Public Works Act, 1928, subject to a Condition as to the
Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 18th day of
February, 1935.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Wellington City Council on the
seventeenth day of May, one thousand nine hundred and thirty-
four, viz. :—

“ The Wellington City Council, being the local authority
having control of the streets in the City of Wellington,
by resolution declares that the provisions of section one
hundred and twenty-eight of the Public Works Act, 1928,
shall not apply to that part of the southern side of Seine
Street fronting Lot 563, D.P. 816 ” :

subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the southern
side of the portion of Seine Street (described in the Schedule
hereto) within a distance of thirty-three feet from the centre-
line of the said portion of street.

SCHEDULE.

THE southern side of all that portion of street, situated in the
Wellington Land District, City of Wellington, known as
Seine Street, fronting Lot 563, D.P. 816, being all of the land
contained in Certificate of Title, Volume 116, folio 278
(Wellington Registry). As the said portion of street is more
particularly delineated on the plan marked P.W.D. 89006,
deposited in the office of the Minister of Public Works at
Wellington, and thereon coloured red.

Arrangements for taking Poll respecting Proposed
Borough of Te Puke.

BLEDISLOE, Governor-General.

PURSUANT to the powers vested in me in that behalf
by section one hundred and thirty-five of the
Municipal Corporations Act, 1933, I, Charles, Baron
Bledisloe, the Governor-General of the Dominion of New
Zealand, do hereby direct that a poll shall be taken on
the proposal that the area described in the Schedule
hereto may be constituted a borough under the said
Municipal Corporations Act, 1933, by name the Borough
of Te Puke; and further I do hereby make the following
appointments and arrangements for the purpose of
taking the said poll:—

  1. Horace William Earp, Esquire, of Te Puke, to be
    the Returning Officer for the purpose of taking the said
    poll and also to be the person authorized to prepare a
    voters’ roll of the persons entitled to vote at the said
    poll.

  2. The voters’ roll prepared and signed by the said
    Horace William Earp shall be the voters’ roll to be used
    at the said poll.

  3. The said poll shall be taken on Wednesday, the
    thirteenth day of March, one thousand nine hundred
    and thirty-five, and shall close at six o’clock in the
    afternoon of that day.

  4. Except as herein provided, the poll shall be taken
    as nearly as may be in the manner provided by the
    Local Elections and Polls Act, 1925, and the Returning
    Officer hereby appointed shall be deemed to be a
    Returning Officer appointed for the purpose of that Act.

SCHEDULE.

AREA PROPOSED TO BE CONSTITUTED THE BOROUGH OF
TE PUKE.

ALL that area in the Auckland Land District, situated
in Block II, Maketu Survey District: Bounded by a
line commencing at the north-western corner of Section
No. 12, Block II aforesaid, on the eastern side of No. 3
Road; thence along the northern and eastern boundaries
of the said Section No. 12 and the eastern boundary of
Section No. 11 to the north-western corner of Section
No. 15; thence along the northern boundary of that
section to the north-western corner of the subdivision of
the said Section No. 15, shown on plan No. 6691, de-
posited in the office of the District Land Registrar at
Auckland; thence along the western and southern bound-
aries of that subdivision to No. 2 Road; thence along
the western side of that road to a point in line with
the southern boundary of Section No. 19; thence across
No. 2 Road and along its eastern side to the north-
western corner of Section No. 19 aforesaid; thence along
the northern boundary of that section to and across
No. 1 Road; thence northerly along the eastern side of
that road, across the main Tauranga–Rotorua Road, and
along its eastern side to the north-western corner of
Section No. 22 (cemetery reserve); thence along a right
line to a point on the northern boundary of the eastern
portion of Section No. 21, distant 250 links from the
north-western corner of the said eastern portion of Sec-
tion No. 21; thence westerly along the northern
boundaries of the eastern and western portions of the
said Section No. 21 for a distance of 500 links; thence
northerly at right angles to the last-mentioned boundary
to a point in line with the northern boundary of Section
No. 35; thence westerly to and along the northern
boundary of the said Section No. 35 and that boundary
produced to the eastern boundary of Section No. 56;
thence along a right line parallel to the south-western
boundary of that section to the southern boundary of
Section No. 55; thence westerly along the southern
boundary of that section and along its western boundary
to the road forming the northern boundary of Section
No. 60; thence along the southern side of that road to
the main Tauranga–Rotorua Road; thence along the
eastern side of that road to a point in line with the
eastern side of No. 3 Road; thence across the Tauranga–
Rotorua Road and along the eastern side of No. 3 Road
to the place of commencement, as set out in the New
Zealand Gazette No. 37, at page 1503.

As witness the hand of His Excellency the Governor-
General, this 13th day of February, 1935.
