A PROCLAMATION.

IN pursuance and exercise of the powers conferred by section twelve of the Land Act, 1924, I, Charles, Baron Bledisloe, Governor-General of the Dominion of New Zealand, do hereby proclaim as closed the roads in Cobden Survey District described in the Schedule hereto.

Amending the Waihi Borough Loans Conversion Order, 1934.

ORDER IN COUNCIL.

At the Government House at Wellington, this 18th day of February, 1935.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the power and authority conferred by subsection two of section thirteen of the Local Authorities Interest Reduction and Loans Conversion Act, 1932–33, and of all other powers and authorities enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and by way of amendment of the Waihi Borough Loans Conversion Order, 1934, made on the ninth day of July, one thousand nine hundred and thirty-four, and published in the Gazette of the thirteenth day of July, one thousand nine hundred and thirty-four, doth prescribe and order as follows :—

  1. This Order may be cited as the Waihi Borough Loans Conversion Amendment Order, 1935, and shall form part of and be read together with the Waihi Borough Loans Conversion Order, 1934 (hereinafter referred to as “the principal Order”).

  2. This Order shall be deemed to have come into force on the ninth day of July, one thousand nine hundred and thirty-four, being the date of the making of the principal Order.

  3. The principal Order is hereby amended by revoking subclause one of clause thirteen thereof, and by inserting the following new subclause :—

“13. (1) New securities shall be issued in substitution for existing securities as follows :—

“(a) In substitution for existing securities by way of debenture, debentures in the form numbered (2) in the Second Schedule hereto.

“(b) In substitution for existing securities by way of collateral mortgage or charge, new instruments in the same form as such existing securities mutatis mutandis but expressed collaterally to secure payment of the amounts provided by this Order at the times and in manner so provided :

“Provided that for the purpose of preserving lenders’ priorities it shall be lawful for any existing collateral security to be continued in force if by instrument endorsed thereon or annexed or made supplemental thereto it be varied so far as is necessary to carry out the effect of the conversion.

“Provided also that execution and delivery of an instrument effecting such variation shall in respect of such security be deemed sufficient compliance with the provisions of clause eleven hereof relating to the surrender of existing securities.”

Authorizing the Exchange of Part of a Reserve in the Village of Panmure, North Auckland Land District, for other Land.

ORDER IN COUNCIL.

At the Government House at Wellington, this 18th day of February, 1935.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the land described in the First Schedule hereto is a reserve duly set apart for the purposes of a landing-place : And whereas it is expedient that the said land should be exchanged for the land described in the Second Schedule hereto, which the Governor-General deems at least of equal value and more suitable for the purposes of the reserve :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section eight of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that the land described in the First Schedule hereto may be exchanged for the land described in the Second Schedule hereto.

FIRST SCHEDULE.
DESCRIPTION OF RESERVE AUTHORIZED TO BE EXCHANGED.

North Auckland Land District.

ALL that area containing by admeasurement 3 perches, more or less, being part Lot 25 of Section 3, Village of Panmure, set aside as Landing Reserve by the New Zealand Gazette, 1891, No. 68, page 1050 : Bounded towards the north by part Lot 42 of Section 3, Village of Panmure, 85·4 links ; towards the south-east by other part Lot 25 aforesaid, 41·5 links ; towards the south-west by part Lot 23 of Section 3, Village of Panmure, 78·9 links. As the same is more particularly delineated on the plan marked L. and S. 6/9/45, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. (North Auckland plan S.O. 27201.)

SECOND SCHEDULE.
DESCRIPTION OF LAND TO BE OBTAINED IN EXCHANGE THEREFOR.

North Auckland Land District.

ALL that area containing by admeasurement 11 perches, more or less, being part Lot 23 of Section 3, Village of Panmure : Bounded towards the north-east by part Lot 25 of Section 3, Village of Panmure, set aside as Landing Reserve by New Zealand Gazette, 1891, No. 68, page 1050, 14·2 links ; towards the south-west by Lot 24 of Section 3, Village of Panmure, set aside as Landing Reserve by New Zealand Gazette aforesaid, 284·6 links ; towards the south by a public road, 36·2 links ; towards the north-west by the other part Lot 23 aforesaid, 300·13 links. As the same is more particularly delineated on the plan marked L. and S. 6/9/45A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged green. Prescribing Subsidy payable to Dunedin Metropolitan Fire Board.

ORDER IN COUNCIL.

At the Government House at Wellington, this 18th day of February, 1935.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the power and authority conferred upon him by section four of the Fire Brigades Amendment Act, 1932, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby prescribe the sum of two hundred and fifty pounds as the sum to be payable annually to the Dunedin Metropolitan Fire Board.
