The South-western Side of Portion of Wesley Road, in the City of Wellington, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 10th day of December, 1934.

Present:

His Excellency the Governor-General in Council.

In pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the seventeenth day of May, one thousand nine hundred and thirty-four, viz.:

"The Wellington City Council, being the local authority having control of the streets in the City of Wellington, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that part of the south-western side of Wesley Road fronting land comprised in Deposited Plan No. 3867"; subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of Wesley Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

The south-western side of all that portion of street, situated in the Wellington Land District, City of Wellington, known as Wesley Road, fronting the land comprised in Deposited Plan No. 3867, being all of the land contained in Certificate of Title, Volume 434, folio 210 (Wellington Registry). As the said portion of street is more particularly delineated on the plan marked P.W.D. 88635, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Validating Loans Conversion Proceedings of Patea Harbour Board.

ORDER IN COUNCIL.

At the Government House at Wellington, this 10th day of December, 1934.

Present:

His Excellency the Governor-General in Council.

Whereas by an Order in Council dated the twentieth day of November, one thousand nine hundred and thirty-three, and published in the Gazette of the twenty-third day of November, one thousand nine hundred and thirty-three, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by the Local Authorities Interest Reduction and Loans Conversion Act, 1932-33 (hereinafter called "the said Act"), did consent to the issue by the Patea Harbour Board (hereinafter called "the said Board") of new securities in conversion of any existing securities to which the said Order applies, and did thereby make the provisions contained in the said Order in Council:

And whereas by the said Order in Council the first day of December, one thousand nine hundred and thirty-three, was fixed as the date from which the conversion of existing securities into new securities should take effect:

And whereas by a resolution passed and confirmed as provided by subsection two of section nine of the said Act the said Board resolved that conversion of the existing securities to which the said Order applies be proceeded with, but the said resolution contained no specific reference to the issue of new securities in conversion of such existing securities:

And whereas such resolution was confirmed after the first day of December, one thousand nine hundred and thirty-three—to wit, on the twentieth day of December, one thousand nine hundred and thirty-three—and the provisions of the said Order in Council then came into force:

And whereas the notice under subclause one of clause six of the said Order in Council was not forwarded by the said Board to the holders of existing securities to which the said Order applies prior to the date of conversion as required by the said subclause one of clause six:

And whereas the said notice was forwarded to such holders after the date of conversion, and none of such holders signified dissent from such conversion:

And whereas it is desirable to validate the proceedings aforesaid:

Now, therefore, in pursuance and exercise of the powers and authorities conferred on him by section two of the Local Authorities Interest Reduction and Loans Conversion Amendment Act, 1934, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the proceedings of the said Board in connection with the said resolution and the said notice shall be valid to all intents and purposes as though—

(a) The said resolution had contained a specific reference to the issue of new securities in conversion of the existing securities mentioned in the said resolution;

(b) The said resolution had been passed and confirmed prior to the first day of December, one thousand nine hundred and thirty-three; and

(c) The notice under subclause one of clause six of the said Order in Council had been forwarded by the said Board to the holders of existing securities to which the said Order applies prior to the date of conversion as required by the said subclause one of clause six;

and that neither the said proceedings nor any new securities issued by the said Board shall hereafter be questioned in any Court on the ground of any such irregularity, defect, invalidity, or omission aforesaid.

Vesting the Control of Part of a Reserve for a Resting-place for Travelling Stock in the Cook County Council.

ORDER IN COUNCIL.

At the Government House at Wellington, this 10th day of December, 1934.

Present:

His Excellency the Governor-General in Council.

Whereas the land described in the Schedule hereto is portion of an area permanently reserved for a resting-place for travelling stock: And whereas it is expedient that the control of the said portion of a reserve should be vested in the Cook County Council:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section seventeen of the Public Reserves, Domains and National Parks Act, 1928, doth hereby vest the control of the said portion of a reserve in the Cook County Council.

SCHEDULE.

All that area in the Gisborne Land District, situated in Block VIII, Hangaroa Survey District, containing 2 acres 2 roods 30 perches, more or less, being part of Section No. 86, Hangaroa Village, and being also part of the land reserved as a resting-place for travelling stock, and described in Gazette, 1907, page 3550, as the same is more particularly described as follows: Commencing at a point on the Hangaroa River where the Gisborne-Hangaroa Road meets the said Hangaroa River, and bounded to the north-west generally by the said Gisborne-Hangaroa Road a distance of 679·8 links to Bruce Street; thence towards the north-east by the said Bruce Street a distance of 1240 links to the Hangaroa River; thence towards the south generally by the said Hangaroa River to the point of commencement. Be all the aforesaid linkages more or less. As the same is delineated on the plan marked L. and S. 9/1836A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red. (Gisborne plan C.P. 3921.)
