Fixing Special Sitting of the Court of Appeal.

ORDER IN COUNCIL.
At the Government House at Wellington, this 31st day of January, 1933.
Present:
His Excellency the Governor-General in Council.
WHEREAS by section two of the Judicature Amendment Act, 1932-33, it is enacted that in addition to the sittings of the Court of Appeal fixed pursuant to section eight of the Judicature Amendment Act, 1919, and notwithstanding anything to the contrary in that Act, special sittings of the said Court shall be held at such times and places as may in accordance with that section be from time to time appointed by the Governor-General by Order in Council published in the Gazette, and that the authority conferred on the Governor-General by that section shall be exercised only on the certificate of the Chief Justice given on the ground that it is not desirable or expedient that the hearing of any appeal or other proceeding, to be specified in the certificate, should be deferred until the next ordinary sitting of the Court of Appeal:
And whereas the Chief Justice has certified that it is not desirable or expedient that the application by Edward Tarrant for a new trial on an indictment charging him that on or about the third day of November, one thousand nine hundred and thirty-one, he did murder one James Flood, and the determination of the questions of law arising on the trial of such indictment reserved in a case stated by the Supreme Court on the fourteenth day of December, one thousand nine hundred and thirty-two, should be deferred until the next ordinary sitting of the Court of Appeal appointed to be held on the thirteenth day of March, one thousand nine hundred and thirty-three:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand in exercise of the powers conferred by the said Act, and all other powers him thereunto enabling, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint and declare that a special sitting of the Court of Appeal of New Zealand shall be held within the Supreme Court House in the City of Wellington, commencing upon Wednesday, the first day of February, one thousand nine hundred and thirty-three, at half past ten o'clock in the forenoon, for the purpose of hearing such application and determining such questions of law.
