The Western Side of Portion of Gover Street, in the Borough of
New Plymouth, exempted from the Provisions of Section 128
of the Public Works Act, 1928, subject to a Condition as to
the Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 10th day of
July, 1933.
Present:
THE RIGHT HON. J. G. COATES PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the New Plymouth Borough Council on
the twentieth day of January, one thousand nine hundred
and thirty, viz:—
“ That the New Plymouth Borough Council, being the
local authority having control of the street hereinafter
mentioned, hereby resolves and declares that the pro-
visions of section one hundred and twenty-eight, subsection
one, of the Public Works Act, 1928, shall not apply to that
portion of the western side of Gover Street to which Section
978, New Plymouth, has frontage”;
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the western
side of the portion of Gover Street (described in the Schedule
hereto) within a distance of thirty-three feet from the centre-
line of the said portion of street.
SCHEDULE.
THE western side of all that portion of street situated in the
Taranaki Land District, Borough of New Plymouth, known
as Gover Street, fronting Section 978, Town of New Plymouth.
As the said portion of street is more particularly delineated
on the plan marked P.W.D. 85750, deposited in the office of
the Minister of Public Works at Wellington, and thereon
coloured red.

Domain Board appointed to have Control of the Waitahuna
Domain.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 10th day
of July, 1933.
Present:
THE RIGHT HON. J. G. COATES PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred by
section forty-four of the Public Reserves, Domains, and
National Parks Act, 1928, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with
the advice and consent of the Executive Council of the said
Dominion, doth hereby appoint
Alfred Bowden Rowe,
Andrew Wightman,
William McKenzie,
Frederick Ellis,
Hugh Blaikie Ross Crozier,
John Auld, and
Alfred Brook
to be the Waitahuna Domain Board, having control of the
land described in the Schedule hereto; and doth hereby
appoint Thursday, the tenth day of August, one thousand
nine hundred and thirty-three, at 8 p.m. as the time when,
and the Bandroom, Waitahuna, as the place where, the first
meeting of the Board shall be held.

OTAGO LAND DISTRICT.—WAITAHUNA DOMAIN.
SECTION 21, Block XXXII, Town of Havelock : Area, 5 acres
I rood 32 perches, more or less.

Validating Irregularity in connection with Annual Meeting of
Ashley County Council.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 10th day of
July, 1933.
Present :
THE RIGHT HON. J. G. COATES PRESIDING IN COUNCIL.
WHEREAS by section seventy-seven of the Counties
Act, 1920 (hereinafter referred to as “the said Act”),
it is provided that the annual meeting of the various County
Councils throughout the Dominion shall be held at noon on
the fourth Wednesday in May :
And whereas the annual meeting of the Ashley County
Council was omitted to be held on the day provided by the
said section seventy-seven of the said Act, but was held on
the first day of June, one thousand nine hundred and thirty-
three, and it is expedient to validate the proceedings in
connection therewith :
Now, therefore, in pursuance and exercise of the power
and authority vested in him by section two hundred and
sixteen of the said Act, His Excellency the Governor-General,
acting by and with the advice and consent of the Executive
Council, doth hereby declare that the proceedings in connection
with the meeting of the Ashley County Council held on the
first day of June, one thousand nine hundred and thirty-
three, shall be valid to all intents and purposes as if such
meeting had been held on the day provided by the said
section seventy-seven of the said Act; and doth further
declare that the said proceedings shall not be called in question
by reason only of the irregularity aforesaid.
