Minister’s Decisions under Sales Tax Act, 1932–33.

Customs Department,
Wellington, 13th June, 1933.

IT is hereby notified for public information that the Minister of Customs has decided to interpret the Sales Tax Act, 1932–33 (hereinafter referred to as “the Act”), as under:—
It should be understood that the decisions contained herein may be revised from time to time in the light of further information which may be obtained by the Minister.

C (s) 26/1 15 For the purposes of the Act it has been decided that, as a general rule, the following will be regarded as materials used in the manufacture of goods :—

(1) Materials that are physically incorporated in the finished product; and
(2) Materials that are not physically incorporated in the finished product but are employed directly in the process of production in the course of which they are wholly consumed or are recovered to a greater or lesser extent from the operations for future use.
The following are examples of the materials referred to above :—
(1) Printing-paper and printing-ink which are physically incorporated in printed books.
(2) Sensitized photographic surfaces and chemicals used in the development of photographic plates or prints, or type-metal which is used many times.
The following would not be regarded as materials used in the manufacture of goods :—
(a) Plant, machinery, and tools, also materials used in their operation or maintenance.
(b) Articles and materials used in the maintenance or repair of buildings.
(c) Articles used directly or indirectly in the distribution or sale of goods.
The liability to sales tax of such goods would depend upon whether or not they were included in any list of exemptions for the time being in force under section 12 of the Act. The following are examples of the foregoing :—
(a) Typewriters and weighing-machines, also lubricating oil therefor.
(b) Electric lamp bulbs, electric switches, and paint.
(c) Office stationery, furniture and equipment, motor-vehicles, and advertising matter for the sale of goods. |

NOTICE is hereby given that the mining privileges mentioned in the Schedule hereto have been struck off the Mining Register, in pursuance of section 188 (4) of the Mining Act, 1926.
