And whereas an application has been made by the Nelson City Council, in accordance with the provisions of the said Act, and it appears expedient to grant the said application:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare the City of Nelson to be a fire district under the said Act, as on and from the second day of June, one thousand nine hundred and thirty-three.

Order in Council authorizing the borrowing by the Taranaki County Council by way of Hypothecation of Debentures issued in respect of a Loan of £600.

At the Government Buildings at Wellington, this 2nd day of June, 1933.

THE RIGHT HON. J. G. COATES PRESIDING IN COUNCIL.

WHEREAS the Taranaki County Council (hereinafter called “the said local authority”) has been authorized to borrow, in respect of the Dover Road Loan, 1932, the sum of six hundred pounds (£600), and the said sum has not yet been borrowed:

And whereas the said local authority is desirous of borrowing the said sum of six hundred pounds (£600), pursuant to section thirty-four of the Local Bodies’ Loans Act, 1926, by the hypothecation or mortgage of the debentures authorized to be issued in respect of the said loan:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section seven of the Local Authorities Interest Reduction and Loans Conversion Act, 1932-33, and of all other powers and authorities enabling him in this behalf, doth hereby consent to the borrowing by the said local authority of the said sum of six hundred pounds (£600) by the hypothecation or mortgage of the said debentures, at a rate of interest not exceeding five pounds (£5) per centum per annum, and the said local authority is hereby authorized to borrow the said sum accordingly.

WHEREAS the Wellington City Council (hereinafter called “the said local authority”) has been authorized to borrow, in respect of the Overdraft and Sundry Works Loans 1898 Repayment Loan 1908 Repayment Loan, 1933, the sum of forty-six thousand nine hundred pounds (£46,900), and the said sum has not yet been borrowed:

And whereas the said local authority is desirous of borrowing the said sum, pursuant to section thirty-four of the Local Bodies’ Loans Act, 1926, by the hypothecation or mortgage of the debentures authorized to be issued in respect of the said loan:

WHEREAS the Wellington City Council (hereinafter called “the said local authority”) has been authorized to borrow, in respect of the Abattoir, Miramar, Karori, and Onslow Loans Repayment Loan, 1933, the sum of sixty-six thousand six hundred pounds (£66,600), and the said sum has not yet been borrowed:

And whereas the said local authority is desirous of borrowing the said sum, pursuant to section thirty-four of the Local Bodies’ Loans Act, 1926, by the hypothecation or mortgage of the debentures authorized to be issued in respect of the said loan:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section seven of the Local Authorities Interest Reduction and Loans Conversion Act, 1932-33, and of all other powers and authorities enabling him in this behalf, doth hereby consent to the borrowing by the said local authority of the said sum of sixty-six thousand six hundred pounds (£66,600) by the hypothecation or mortgage of the said debentures, at a rate of interest not exceeding five pounds per centum per annum, and the said local authority is hereby authorized to borrow the said sum accordingly.

Order in Council consenting to the Raising of a Loan of £1,400 by the Heathcote County Council.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 2nd day of June, 1933.

Present:

THE RIGHT HON. J. G. COATES PRESIDING IN COUNCIL.

WHEREAS the Heathcote County Council (hereinafter called “the said local authority”), is desirous of raising the sum of one thousand four hundred pounds (£1,400) by a loan to be known as “St. Andrews Hill Sewerage Loan, 1933,” for the purpose of installing a sewerage system at St. Andrews Hill, Mount Pleasant, in Heathcote County:

And whereas the said local authority has complied with the provisions of the Local Government Loans Board Act, 1926 (hereinafter called “the said Act”), and it is expedient that the precedent consent of the Governor-General in Council under the said Act should be given to the raising of the said loan on the terms and conditions hereinafter set forth:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the said Act (as set out in section twenty-nine of the Finance Act, 1932 (No. 2)), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising by the said local authority of the said loan up to the amount of one thousand four hundred pounds (£1,400) for a term of thirty (30) years, at such rate or rates of interest as shall not produce to the lenders a rate exceeding the rate of four pounds five shillings (£4 5s.) per centum per annum, subject to the condition that the said local authority shall, before borrowing the said loan or any part thereof, make provision for the repayment thereof by establishing a sinking fund under the Local Bodies’ Loans Act, 1926, and shall thereafter make to such sinking fund payments at intervals of not more than one year, at a rate or rates which shall be not less than the rate of one pound fifteen shillings (£1 15s.) per centum, such payments to be made in respect of every part of the said sum for the time being so borrowed and not repaid, the first payment to be made not later than one year after the first day from which interest to the lender is computed on any moneys so borrowed and subject to the further conditions that no portion of interest or sinking fund shall be paid out of loan-moneys, and that the local authority shall not enter into any contract for payment of brokerage at a rate exceeding one half per centum on any sum borrowed pursuant to this consent.
