Order in Council consenting to the borrowing of Moneys by the Otago Electric-power Board by way of Bank Overdraft.

BLEDISLOE, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 13th day of February, 1933.

Present:

His Excellency the Governor-General in Council.

WHEREAS the Otago Electric-power Board (hereinafter called “the said local authority”) is desirous of borrowing moneys by way of bank overdraft, under section fifty-two of the Finance Act, 1930 (No. 2):

And whereas the said local authority has complied with the provisions of the Local Government Loans Board Act, 1926 (hereinafter called “the said Act”), and it is expedient that the precedent consent of the Governor-General in Council under the said Act should be given to the borrowing as aforesaid on the terms and conditions hereinafter set forth:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by the said Act, and of all other powers and authorities enabling him in this behalf, doth hereby consent to the borrowing of moneys by the said local authority under the said section fifty-two, to the following extent and subject to the following conditions:—

  1. Such borrowing may be from time to time by way of overdraft, or from any person or persons.

  2. The rate of interest payable from time to time shall not exceed current bank overdraft rates of interest to best customers.

  3. No money so borrowed shall be used for any purposes except that of meeting initial losses.

  4. No money shall be borrowed under this authority at any time after the thirty-first day of March, nineteen hundred and thirty-three.

  5. The total amount owing (including unpaid interest) of the moneys so borrowed shall not on the thirty-first day of March, nineteen hundred and thirty-three, exceed the amount permitted by the provisions of the said section fifty-two to be owing at the end of the financial year 1932–33.

Revoking Order in Council of the 23rd Day of April, 1923, licensing Noel Robert Archibald Cox and Others to use and occupy a Part of the Foreshore at Tikiliki Cliff, Chatham Islands, as a Site for a Cattle-yard.

His Excellency the Governor-General in Council.

WHEREAS by Order in Council dated the twenty-third day of April, one thousand nine hundred and twenty-three, and published in the Gazette of the third day of the following month at page 1253, Noel Robert Archibald Cox, Frank Regnault, Harry George Blyth, Jose Santos, and Susan Shand (hereinafter called “the licensees”), were licensed to use and occupy a part of the foreshore at Tikiliki Cliff, Chatham Islands, as a site for a cattle-yard:

And whereas the licensees have applied to have the hereinbefore-recited Order in Council revoked, and it is desirable to revoke the same:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the Harbours Act, 1923, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke and determine the said recited Order in Council of the twenty-third day of April, one thousand nine hundred and twenty-three, as from the thirty-first day of March, one thousand nine hundred and thirty-three.

Regulations under Hawke’s Bay Earthquake Act, 1931, relative to Preparation of District Electors List for Borough of Napier.

ORDER IN COUNCIL.
At the Government House at Wellington, this 13th day of February, 1933.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred on him by the Hawke’s Bay Earthquake Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following regulations.

REGULATIONS.

  1. THESE regulations may be cited as the Napier Borough Electoral Regulations, 1933.

  2. The district electors roll at present in force for the Borough of Napier is hereby declared to be null and void and for the purposes of compiling the district electors list for the said borough during the current year (hereinafter referred to as “the list”) it shall not be nor be deemed to have been necessary for the Town Clerk to comply with the provisions of Regulation 5 of the regulations made under the Municipal Corporations Act, 1920, on the 30th day of August, 1921, and published in the Gazette on the 1st day of September, 1931 (hereinafter referred to as “the said regulations”).

  3. The several dates hereinafter mentioned are hereby fixed in lieu of the dates fixed by the Municipal Corporations Act, 1920, and the said regulations for the taking of the appropriate steps incidental to the correcting, completing, and authenticating of the list:—

(a) Council to hold sitting to amend list not later than 28th day of February, 1933.

(b) Appeals to Magistrate against list may be made not later than the 3rd day of March, 1933.

(c) Magistrate to hear and determine appeals not later than the 10th day of March, 1933.

(d) List to become district electors roll on the 13th day of March, 1933.

Vesting Reserves in the Chairman, Councillors, and Inhabitants of the Heathcote County.

ORDER IN COUNCIL.
At the Government House at Wellington, this 13th day of February, 1933.

Present:

His Excellency the Governor-General in Council.

WHEREAS the land described in the First Schedule hereto has been duly set apart as a reserve for public utility:

And whereas the land described in the Second Schedule hereto has been duly set apart as a reserve for a reservoir:

And whereas it is expedient to vest the said reserves in the Chairman, Councillors, and Inhabitants of the Heathcote County:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section nine of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that, from and after the day of the date hereof, the reserves described in the Schedules hereto shall become vested in the Chairman, Councillors, and Inhabitants of the Heathcote County, in trust, for their respective purposes.

FIRST SCHEDULE.

CANTERBURY LAND DISTRICT.

RESERVE 4133, Block XV, Christchurch Survey District: Area, 31·8 perches, more or less.

SECOND SCHEDULE.

CANTERBURY LAND DISTRICT.

RESERVE 4301, Block XV, Christchurch Survey District: Area, 1 rood 4·6 perches, more or less.
