Authorizing the Acquisition of Native Land notwithstanding the Provisions as to Limitation of Area.

ORDER IN COUNCIL.

At the Government House at Wellington, this 21st day of November, 1932.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by section two hundred and forty-six of the Native Land Act, 1931, it is enacted that the Governor-General may by Order in Council, in any case in which he deems it expedient in the public interest so to do, authorize any acquisition, alienation, or disposition of any land, or any interest therein, notwithstanding the statutory provisions therein referred to:

And whereas it appears expedient to authorize the acquisition, alienation, or disposition of the land hereinafter mentioned:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority hereinbefore mentioned, and all other powers him enabling, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the alienation by way of transfer to and the acquisition thereof by Timberlands Woodpulp Extended, Limited, of the land mentioned in the Schedule hereto, notwithstanding the provisions of Part XII of the Native Land Act, 1931, or of sections 72 to 76 of the Native Land Amendment Act, 1913.

SCHEDULE.

ALL and every of the following parcels of land situate in the Waiariki District:—

(1) Part Matahina A 1d, containing 20,154 acres and 27 perches, being all the land comprised and described in Register-book, Vol. 631, folio 87, of the Auckland Land Registry.

(2) Part Matahina B 2 containing 587 acres, being all the land in Register-book, Vol. 622, folio 283, of the Auckland Land Registry.

Hawke’s Bay Earthquake (Napier Harbour Board) Regulations.

ORDER IN COUNCIL.

At the Government House at Wellington, this 21st day of November, 1932.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred on him by section sixty-six of the Hawke’s Bay Earthquake Act, 1931, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations for the purposes of the said Act.

REGULATIONS.

  1. THESE regulations may be cited as the Napier Harbour Board (Finance) Regulations, 1932, and the Napier Harbour Board is hereinafter referred to as “the Board.”

  2. The Board is hereby authorized to use the unexpended balance—viz., six thousand eight hundred and thirty-six pounds two shillings and eightpence (£6,836 2s. 8d.), of the allocation of eight thousand pounds (£8,000) of the Earthquake Relief Loan, 1931, of twenty-two thousand pounds (£22,000) for the purpose of completing repairs to the Glasgow Wharf and for carrying on dredging operations at the Breakwater Harbour and between the piers at the Inner Harbour.

  3. The payment by the Board out of the allocation of fourteen thousand pounds (£14,000) of the Earthquake Relief Loan, 1931, of twenty-two thousand pounds (£22,000), of the sums of eight hundred and thirteen pounds five shillings and tenpence (£813 5s. 10d.) for providing lightering facilities at the Breakwater Harbour, and four hundred and thirty-five pounds six shillings and ninepence (£435 6s. 9d.) for plant for the dredge “Kaione,” is hereby validated.

  4. The remission by the Board during the financial year ended 30th September, 1931, of harbour dues amounting to five hundred and four pounds five shillings and ninepence (£504 5s. 9d.) is hereby validated.

Ohai Railway District.—Altering the Division of the District into Subdivisions for the Purposes of Representation, and altering Representation and Number of Members of Board, and revoking previous Provisions.

ORDER IN COUNCIL.

At the Government House at Wellington, this 21st day of November, 1932.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred on him by the Local Railways Amendment Act, 1926, the Ohai Railway Board Act, 1932, and of every other power and authority in anywise enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the Order in Council dated the twenty-seventh day of September, one thousand nine hundred and twenty-six, and for the purposes of representation doth hereby divide the Ohai Railway District into the following subdivisions, which are more particularly described in the Schedule hereto, and doth determine that the number of members of the Board including members elected in accordance with section four of the Ohai Railway Board Act, 1932, shall be seven, and doth determine that the number of representatives of each subdivision on the Board of the said district shall be the number hereafter specified opposite the name of that subdivision:—

Waiau Subdivision . . . . Two members.
Wairaki Subdivision . . . . One member.
Ohai Subdivision . . . . One member.

WAI AU SUBDIVISION.

THAT part of the Ohai Railway District bounded as follows: By a line commencing at the south-western corner of Section 84, Block VI, Wairio Survey District, on the southern boundary of the Ohai Railway District; thence generally in a northerly direction along the western boundary of the said Section 84 to the south-eastern corner of Lot 9, Land Transfer Plan 1289 (Birchwood Estate); thence along the southern and western and northern boundaries of the said Lot 9 to the Orauea Stream; thence generally in a westerly direction along the said Orauea Stream to the south-western corner of Lot 15, Land Transfer Plan 1289; thence in a north-easterly direction along the western boundary of the said Lot 15, and a northerly direction along the western boundary of Lot 19, Land Transfer Plan 1289; thence in an easterly direction along the northern boundary of the said Lot 19 to the south-western corner of Lot 20, Land Transfer Plan 1289; thence in a northerly direction along the western boundary of the said Lot 20 to the Ohai Stream; thence in a westerly direction along the Ohai Stream to the south-eastern corner of Section 17, Block XXVI, Wairaki Survey District; thence generally in a north-westerly and then in a north-easterly direction along the boundary of the said Section 17 to the south-eastern corner of Section 78, Block XXV, Wairaki Survey District; thence generally in a westerly and northerly and easterly and northerly direction along the southern and western boundaries of the said Section 78 to the north-eastern corner of Section 35, Block XXV, Wairaki Survey District; thence generally in a westerly direction along the southern boundary of Section 76, Blocks XIX and XX, Wairaki Survey District, and generally in a north-westerly direction along the western boundary of the said Section 76, Block XIX, Wairaki Survey District, to the southern corner of Lot 2 (D.P. 2494) of Sections 75 and 76, Blocks XIX and XX, Wairaki Survey District; thence generally in a north-easterly direction along the eastern boundary of the said Lot 2, and of Lot 1, on the said deposited plan to the north-eastern corner of the said Lot 1; thence generally in an easterly direction along the northern boundary of Section 75, Blocks XIX and XX, Wairaki Survey District, and thence generally in a northerly direction along the western boundary of Section 80, Block XX, Wairaki Survey District; thence generally in an easterly direction along the northern boundary of the said Section 80 and Section 82, Block XXI, Wairaki Survey District; thence generally in a northerly direction along the eastern boundary of Pastoral Run 143A, and that line produced to the boundary of the Ohai Railway District; thence in a general westerly, southerly, easterly, and then northerly direction along the boundary of the said Ohai Railway District to the commencing-point.

WAI RAKI SUBDIVISION.
