Notifying Land in the Auckland Land District subject to the Land for Settlements Act, 1925.

Department of Lands and Survey,
Wellington, 16th September, 1932.

PURSUANT to the provisions of the Land for Settlements Act, 1925, I hereby notify that the undermentioned land, which has been acquired under the said Act to form part of Wairakau Settlement, is subject to the said Act as from the 30th July, 1932.

SCHEDULE.

AUCKLAND LAND DISTRICT.

ALL that area in the Auckland Land District, containing by admeasurement 59 acres 2 roods 8 perches, more or less, being Section 40, Block XII, Aroha Survey District, bounded towards the north-east by permanent State forest situated in Block VII, Katikati Survey District and provisional State forest situated in Block X, Aongatete Survey District, 1535·0 links; towards the south-east by Section 14s, Wairakau Settlement, and a public road, 3947·7 links; and towards the south-west and north-west by Section 13s, Wairakau Settlement, 1530·0 and 3836·5 links. As the same is more particularly delineated on the plan marked L. and S. 21/149/1152, deposited, under No. 2592, in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. Mount Albert Borough Council.—Cancellation of Unexercised Loan Authority.

In the matter of section 118 of the Local Bodies’ Loans Act, 1926.

WHEREAS the Mount Albert Borough Council has been duly authorized to borrow by way of special loan the sum of three thousand pounds (£3,000) for advances to ratepayers for drainage connections, and the consent of the Governor-General in Council to the raising of the said loan was given by Order in Council made on the 28th day of August, 1922, and published in the Gazette on the 31st day of the same month, at page 2325:

And whereas in respect of the said sum of three thousand pounds (£3,000), there has been raised and borrowed for the purposes aforesaid the sum of one thousand five hundred pounds (£1,500), and it has not been found necessary to borrow the whole of the amount so authorized:

And whereas the Minister of Finance has duly notified the Mount Albert Borough Council in writing of his intention to cancel the loan authority in so far as it has not been exercised:

Now, therefore, in exercise of the powers in that behalf conferred upon me by section 118 of the Local Bodies’ Loans Act, 1926 (amended by section 46 of the Finance Act, 1931, No. 4), and of all other powers me in this behalf enabling, I, George William Forbes, Acting Minister of Finance, do hereby cancel the authority of the Mount Albert Borough Council to borrow, under the loan authority hereinbefore referred to, the sum of one thousand five hundred pounds (£1,500), being the amount in respect of which the said loan authority has not been exercised: Provided always that this cancellation is without prejudice to the validity in all respects of the loan of one thousand five hundred pounds (£1,500) already borrowed pursuant to the said loan authority.
