Partial Revocation of Order in Council vesting Land owned by Natives in a Maori Land Board for Non-payment of Rates.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 10th day of February, 1932.

Present:

THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.

WHEREAS by section sixty-three of the Native Purposes Act, 1931, it is enacted that any Order in Council made under section thirty-two mentioned in the Schedule hereto may at any time be varied or revoked:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred on him by the said section sixty-three and all other power and authority him enabling, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the Order in Council referred to in Part I of the Schedule hereto in so far as it affects the land mentioned in Part II of the Schedule hereto.

SCHEDULE.

PART I.

ORDER in Council under section 32 of the Native Land Amendment and Native Land Claims Adjustment Act, 1928, on the 5th day of December, 1929, and published in the New Zealand Gazette of the 12th day of December, 1929.

PART II.

Makuratawhiti 10A 1 Block: Area, 2 roods 8·5 perches.

Portions of Roads in the County of Waimea exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 10th day of February, 1932.

Present:

THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waimea County Council on the seventh day of January, one thousand nine hundred and thirty-two, viz. :—

“That the Waimea County Council, being the local authority having control of the roads within the Waimea County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the following roads: The south-east side of the road along the north-west boundary of part of Section 64, Block VI, Waimea Survey District, nor to the south-west side of the road fronting north-east boundary of the aforesaid part of Section 64, Block VI, Waimea Survey District, and part of Section 11 of 1, Block X, Waimea Survey District, as delineated on plan P.W.D. 83203, prepared by F. I. Ledger, Surveyor, and coloured red thereon ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the portions of roads (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of roads.

SCHEDULE.

THE south-eastern side of all that portion of road, in the Nelson Land District, County of Waimea, fronting part Section 64, Waimea East, Block VI, Waimea Survey District; marked “ A–B ” on plan.

The south-western side of all that portion of road fronting part Section 64, Waimea East, Block VI, and part Section 11 of 1, Aniseed Valley, Block X, Waimea Survey District; marked “ A–C ” on plan.

As the said portions of roads are more particularly delineated on the plan marked P.W.D. 83203, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Randolph Terrace, Reserve Terrace, and Watson’s Lane, in the Borough of Lyttelton, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to Conditions as to the Building-lines.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 10th day of February, 1932.

Present:

THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Lyttelton Borough Council on the fifteenth day of June, one thousand nine hundred and thirty-one, viz. :—

“That the Mayor, Councillors, and Burgesses of the Borough of Lyttelton do hereby declare, pursuant to section three of the Borough of Lyttelton Corporation Enabling Act of 1929, that Randolph Terrace, Reserve Terrace, and Watson’s Lane, forming part of Reserve No. 68 in the Borough of Lyttelton, are public streets, and that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the said streets ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting Randolph Terrace and Reserve Terrace (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said streets nor on the land fronting Watson’s Lane (described in the Schedule hereto) within a distance of seventeen feet from the centre-line of the said street, such conditions being of the same effect as the Lyttelton Borough Building-line By-law No. 1 (1932).

SCHEDULE.

ALL those streets situated in the Canterbury Land District, Borough of Lyttelton, known as Randolph Terrace, Reserve Terrace, and Watson’s Lane. As the same are more particularly delineated on the plan marked P.W.D. 82100, deposited in the office of the Minister of Public Works at Wellington, and thereon edged brown.

Regulation under the Public Service Superannuation Act, 1927.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 10th day of February, 1932.

Present:

THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred upon him by section seven of the Public Service Superannuation Act, 1927, and section forty-one of the Finance Act, 1931 (No. 4), His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the consent of the Executive Council of the said Dominion, doth hereby make the following regulation for the purposes of that Act, and doth further declare that the regulation hereby made shall take effect on the first day of November, one thousand nine hundred and thirty-one :—

“For his services in and about the collection of interest or otherwise in respect of such securities in which the moneys of the Public Service Superannuation Fund may be invested the Public Trustee shall be entitled to charge and deduct from such interest fees at the following rates, namely :—

“(a) On interest from Government securities, Land Settlement Finance Act debentures, Rural Advances Bonds, and Rural Intermediate Credit Board debentures, 10s. per centum;

“(b) On interest from local-body debentures, £1 5s. per centum;

“(c) On interest from mortgages and on income from all other forms of security, £3 15s. per centum.”
