Amending the Regulations as to the Use of Nets for taking Fish in certain Waters.

At the Government House at Wellington, this 14th day of September, 1931.

Present:

His Excellency the Governor-General in Council.

WHEREAS by Order in Council dated the third day of April, one thousand nine hundred and twenty-nine, and published in the Gazette of the eleventh day of the same month, at page 959, regulations were made regulating the use of nets for taking fish in certain waters:

And whereas it is expedient to amend the hereinbefore-recited regulations in the manner hereinafter prescribed:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the fifth section of the Fisheries Act, 1908, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke Regulation No. 9 of the hereinbefore-recited regulations, and doth hereby make the following regulation in lieu thereof.

REGULATION.

  1. For the purposes of these regulations-

A "Danish seine net" is a net having a wing on each side of the cod-end or bag, with a warp attached to each wing, and which is operated by being drawn over the sea bottom or through the sea, the power for hauling in the net to the vessel being provided by a winch driven by an internal-combustion or steam engine. Such hauling operations shall be carried out only while the vessel is moored or anchored and not under way.

"Trawling" or "using a trawl net" means drawing a net over the sea bottom, or through the sea by means of one or more vessels under way.

Authorizing the Exchange of a Reserve in Town of Mangaweka, Wellington Land District, for other Land.

At the Government House at Wellington, this 14th day of September, 1931.

His Excellency the Governor-General in Council.

WHEREAS the land described in the First Schedule hereto is a reserve duly set apart for municipal purposes: And whereas it is expedient that the said land should be exchanged for the land described in the Second Schedule hereto, which the Governor-General deems at least of equal value and more suitable for the purposes of the reserve:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section eight of the Public Reserves, Domains, and National Parks Acts, 1928, doth hereby declare that the land described in the First Schedule hereto may be exchanged for the land described in the Second Schedule hereto.

DESCRIPTION OF RESERVE AUTHORIZED TO BE EXCHANGED.

Wellington Land District.

By-laws relating to Picton Harbour.

ORDER IN COUNCIL.

At the Government House at Wellington, this 14th day of September, 1931.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers and authorities conferred on him by sections nine and two hundred and twenty-six of the Harbours Act, 1923, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following by-laws in respect of the Harbour of Picton; and doth hereby order that such by-laws shall come into force on the first day of October, one thousand nine hundred and thirty-one, and that they shall then supersede all by-laws theretofore existing in respect of the said harbour.

BY-LAWS.

PILOTAGE.

  1. The following pilotage rates shall be payable by the owner, agent, or master of any vessel if any one of them shall have applied for or employed a pilot:-

(a) Steamers-

Inward ... ... ... ... $\frac{1}{2}$d. per ton. Outward ... ... ... $\frac{1}{2}$d. per ton.

(b) Sailing vessels-

Inward ... ... ... ... 1d. per ton. Outward ... ... ... 1d. per ton.

  1. Pilotage is compulsory.

HARBOURMASTER'S FEES.

  1. For removing vessels from one place to another within the harbour the Harbourmaster's fees shall be $\frac{1}{2}$d. per ton for steamers and 1d. per ton for sailing vessels: Provided that any vessel which engages the service of a pilot and pays pilotage shall be exempt from Harbourmaster's fees.

PORT CHARGE.

  1. On every vessel over twenty tons net register, whether coming from seaward or not and whether propelled by steam or not, navigating or plying, whether for hire or not, there shall be payable a port charge of 1d. per ton on arrival: Provided that the maximum amount chargeable under this by-law shall not exceed one shilling per ton in any half-year in respect of each vessel.

GENERAL.

  1. For the purposes of these by-laws tonnage shall be deemed to be the net registered tonnage of the ship as specified in her Certificate of Registry, with the addition of such amount of tonnage as may, pursuant to the provisions of section 63 of the Harbours Act, 1923, be added to the ship's registered tonnage.

Cancelling the Reservation over certain Reserves in the Auckland, Taranaki, Nelson, and Canterbury Land Districts.

ORDER IN COUNCIL.

At the Government House at Wellington, this 14th day of September, 1931.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers and authorities conferred upon him by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby cancel the reservation over the lands described in the First, Second, Third, and Fourth Schedules hereto for the various public purposes set out at the end of the respective descriptions of the said lands, and doth hereby declare that the said lands, being vested in the Crown, are Crown lands available for disposal under the Land Act, 1924.
