ORDER IN COUNCIL.

At the Government House at Wellington, this 17th day of August, 1931.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by Order in Council dated the sixteenth day of January, one thousand nine hundred and twenty-two, and published in the Gazette of the nineteenth day of the same month at page 126, George T. Niccol, of Auckland (hereinafter called “the licensee”), was licensed to use and occupy a part of the foreshore at Aoroa, Wairoa River, Kaipara Harbour, as a site for a wharf:

And whereas the licensee has applied to have the hereinbefore-recited license revoked, and it is desirable to revoke the same:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the Harbours Act, 1923, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the hereinbefore-recited Order in Council of the sixteenth day of January, one thousand nine hundred and twenty-two, as from the thirty-first day of March, one thousand nine hundred and thirty-one.

Suspending the Operations of certain Statutes in connection with the Wellington Winter Show and Industrial Exhibition.

ORDER IN COUNCIL.

At the Government House at Wellington, this 17th day of August, 1931.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred upon him by the Exhibitions Act, 1910 (hereinafter called “the said Act”), His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the holding of a public exhibition of works of industry and art to be conducted by the Wellington Show Association (Incorporated) in the Association’s Buildings, Wellington, from the twenty-seventh day of August, one thousand nine hundred and thirty-one, to the twelfth day of September, one thousand nine hundred and thirty-one (both dates inclusive), and to be known as the Wellington Winter Show and Industrial Exhibition, and doth hereby declare the said exhibition to be an exhibition within the meaning of the said Act, and doth hereby suspend, subject, however, to the conditions set out in the Schedule hereto, all the provisions of the Shops and Offices Act, 1921–22, the Factories Act, 1921–22, and the Industrial Conciliation and Arbitration Act, 1925, and of all awards and industrial agreements in force under the last-named Act in so far as such provisions relate to the hours of commencing or ceasing work, or to the issue of permits for overtime or extended hours, or to holidays or half-holidays, or to the closing of shops to any person, and so far as such provisions relate to hours of work done or business conducted or service carried out in or upon the premises aforesaid during the period aforesaid by or on behalf of the bodies conducting the said exhibition, or by or on behalf of any exhibitor of works of industry or art at the said exhibition, or by any person employed in or about the said exhibition.


SCHEDULE.

  1. EIGHT hours shall constitute a day’s work in or about the exhibition, and, with the exception set out in clause 2 hereof, such hours shall be worked consecutively.

  2. No person shall be employed in or about the exhibition for more than four hours without an interval of at least three-quarters of an hour for a meal.

  3. Any person employed during any day in or about the exhibition who is employed on such day in excess of eight hours, or before the hour of 8 a.m. or after the hour of 10.30 p.m. (whether such excess employment is in or about the exhibition or otherwise), shall be paid for such excess employment at not less than one-half as much again as the ordinary rate for the first two hours and at not less than twice the ordinary rate thereafter, and any person employed in or about the exhibition on any day that would, but for the provisions of this Order in Council, have been a whole holiday for such person by virtue of any Act or of any award or industrial agreement, shall be paid for all work done on such day at not less than twice the ordinary rate, whether such work is performed wholly in or about the exhibition or otherwise.

  4. No female shall be employed in or about the exhibition after the hour of 10.30 p.m.

  5. For the purposes of the enforcement of an award or industrial agreement, any provision of which has been suspended by this Order in Council, any officer of the industrial union or association concerned who is authorized in writing in that behalf by such union or association shall be entitled to interview at his place of employment any person employed in or about the exhibition under that award or industrial agreement, at such time or times as may be agreed upon by and between such officer and the employer of such person, and for this purpose any such officer shall be entitled at any reasonable time to have access to the Register of Passes issued by the Wellington Winter Show Association (Incorporated).

  6. Nothing in this Order in Council shall be deemed to affect any provisions in an award or industrial agreement relating to preference of employment.

The North-eastern Side of Portion of Grove Street, in the Borough of St. Kilda, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 17th day of August, 1931.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the St. Kilda Borough Council on the twenty-third day of February, one thousand nine hundred and thirty-one, viz.:

“That the St. Kilda Borough Council, being the local authority having control of the streets in the Borough of St. Kilda, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the portion of Grove Street adjoining part Allotments 1, 2, and 3, Block 45, Musselburgh”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Grove Street (described in the Schedule hereto) within a distance of twenty-six feet from the centre-line of the said portion of street.


SCHEDULE.

THE north-eastern side of all that portion of street situated in the Otago Land District, Borough of St. Kilda, known as Grove Street, fronting part Allotments 1, 2, and 3, Block XLV, Township of Musselburgh. As the said portion of street is more particularly delineated on the plan marked P.W.D. 82310, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
