then, and in either such case, this Order in Council, and every license, right, power, or privilege thereby conferred, may be revoked and determined by the Governor-General in Council without any notice to the licensees or other proceeding whatsoever; and publication in the New Zealand Gazette of an Order in Council containing such revocation shall be sufficient notice to the licensees and to all persons concerned or interested that this Order in Council, and the license, right, and privileges thereby granted and conferred, have been revoked and determined.

  1. In the event of this Order in Council being revoked for any reason whatsoever, or upon the expiry of the period for which the license is granted, the licensees shall, if required by the Minister so to do, remove the said structure entirely from the site, and restore the site to its original condition within three months from the date of revocation or expiry as the case may be; and if the licensees fail so to do, the Minister may cause the said structure to be removed and the site so restored, and may recover the costs incurred by the said removal and restoration from the licensees.

ORDER IN COUNCIL.

At the Government House at Wellington, this 23rd day of April, 1931.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred on him by the Immigration Restriction Act, 1908, and the Immigration Restriction Amendment Act, 1931, and of all other powers and authorities enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that section three of the Immigration Restriction Amendment Act, 1931, shall apply to all persons arriving in New Zealand being persons to whom, whether by reason of British birth and parentage or otherwise, Part I of the Immigration Restriction Amendment Act, 1920, does not apply, and doth make the regulations set forth hereunder.

REGULATIONS.

  1. THESE regulations may be cited as the “Immigration Restriction Regulations 1931.”

  2. Every person to whom section 3 of the Immigration Restriction Amendment Act, 1931, applies who desires to obtain a permit to land in New Zealand shall, if required by the Minister or by some person appointed by him to grant permits under that section, make and deliver to the Minister or to a person so appointed an application in the following form:—

NEW ZEALAND CUSTOMS.

Application for a Permit to land in New Zealand.

(Immigration Restriction Amendment Act, 1931.)

  1. The permit to land in New Zealand under section 3 of the Immigration Restriction Amendment Act, 1931, shall, unless otherwise directed by the Minister, be in the following form, and the conditions set forth therein shall be deemed to be prescribed under that section.

Permit to Land in New Zealand.

Permission is hereby granted to , of , to land in New Zealand accompanied by [Strike out the words “accompanied by” if not required] on the following conditions:—

(1) That this permit will not entitle the person or persons named herein to land in New Zealand after the expiry of six months from the date hereof.
(2) That this permit will be delivered up to the Collector of Customs at the first port of arrival in New Zealand.
(3) That he (she) satisfies the Collector of Customs at the port of arrival that the particulars inserted hereunder concerning himself (herself) are correct.

(5) That he (she) is a person of good character and reputation, that he (she) has never been in prison or in a mental hospital or the recipient of charitable aid, and that he (she) is not a disaffected or disloyal person or one who advocates the overthrow by force or violence of constitutional Government.
(6) If the person(s) authorized to land in New Zealand under this permit is/are (a) person(s) to whom the Immigration Restriction Act, 1908, or the Immigration Restriction Amendment Act, 1920, applies, the permit shall be deemed to be revoked.
