Order in Council consenting to the Newmarket Fire Board borrowing Moneys by way of Bank Overdraft.

ORDER IN COUNCIL.
At the Government House at Wellington, this 13th day of April, 1931.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS the Newmarket Fire Board (hereinafter called the “said local authority”) is desirous of borrowing moneys by way of bank overdraft under section thirty-two of the Fire Brigades Act, 1926;
And whereas the said local authority has complied with the provisions of the Local Government Loans Board Act, 1926 (hereinafter called “the said Act”), and it is expedient that the precedent consent of the Governor-General in Council under the said Act should be given to the borrowing as aforesaid on the terms and conditions hereinafter set forth:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by the said Act, and of all other powers and authorities enabling him in this behalf, doth hereby consent to the borrowing of moneys by the said local authority under the said section thirty-two to the following extent and subject to the following conditions:
(1) Such borrowing may be from time to time by way of bank overdraft.
(2) The rate of interest payable from time to time shall not exceed current bank overdraft rates to best customers.
(3) The total amount owing of money borrowed under this authority including unpaid interest (if any) shall not at any time exceed the sum of one hundred pounds (£100).
(4) The money so borrowed shall be repaid during the financial year ending 31st March, 1932.

The South-eastern Side of Portion of Ann Street, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 13th day of April, 1931.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the eighteenth day of March, one thousand nine hundred and thirty-one, viz.:—
“That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to portion of the south-eastern side of Ann Street, in the said City of Dunedin, where such portion of street abuts on part Lot 5, Deeds Plan 9, Township of Sunnyside; as the said portion of street is more particularly shown on the plan annexed hereto and is thereon coloured brown and edged with red to its centre-line”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Ann Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
The south-eastern side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Ann Street, fronting part Lot 5, Deeds Plan 9, Township of
Sunnyside. As the said portion of street is more particularly delineated on the plan marked P.W.D. 81429, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured brown and edged red.

The Northern Side of Portion of Rona Street, in the Borough of Eastbourne, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 13th day of April, 1931.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Eastbourne Borough Council on the twenty-fourth day of February, one thousand nine hundred and thirty-one, viz.:—
“That the Eastbourne Borough Council, having control of that street known as Rona Street in the Borough of Eastbourne, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the north side of the said street fronting Lot 47, on deposited plan No. 919, being part of Section 37 of Harbour District”; subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Rona Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
The northern side of all that portion of street situated in the Wellington Land District, Borough of Eastbourne, known as Rona Street, fronting Lot 47 on D.P. 919, being part Section 37, Harbour District. As the said portion of street is more particularly delineated on the plan marked P.W.D. 81452, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
