PROHIBITED IMMIGRANT MAY BE DEPORTED.
- Any prohibited immigrant who is found in Samoa may be arrested by any constable (without warrant) and placed and detained on board the ship by which he arrived in Samoa or on board any other ship about to leave Samoa, and may, pending his removal to such ship, be detained in such custody and in such place as the Administrator may direct.
TEMPORARY PERMITS TO FOREIGNERS.
- (1) Notwithstanding the provisions of paragraph (a) of sub-clause (1) of clause 4 of this Order the Administrator may grant a temporary permit in the form and to the effect set out in the Third Schedule hereto to any person of the class defined in the said paragraph who proves to the satisfaction of an officer of Customs or Police that he desires to enter Samoa as a visitor only for the purposes of business, pleasure, or health, and that he intends to leave Samoa within six months from the date of his arrival.
(2) A temporary permit granted under this clause may, in the Administrator’s discretion, include such person’s wife and any one or more members of his family.
PROVISIONS RELATING TO TEMPORARY PERMITS.
- (1) A temporary permit granted under the last preceding clause hereof shall be for such period, not exceeding six months, as the Administrator shall determine (subject always to his right to revoke the same at any time), and subject to such conditions as he may impose.
(2) If any person to whom such temporary permit is granted desires to remain in Samoa beyond the period for which the permit was granted, he may make application to the Administrator, who may in his discretion grant an extension or extensions from time to time of the temporary permit.
OFFENCES AND LIABILITIES.
- (1) Every person shall be liable to a fine not exceeding £100 or to imprisonment for a period not exceeding six months who—
(a) Lands in Samoa in breach of any of the foregoing provisions of this Order; or
(b) Wilfully assists any person to evade or contravene any of the foregoing provisions of this Order; or
(c) Obstructs or hinders any officer in the discharge of his functions or duties under this Order; or
(d) Wilfully assists a prohibited immigrant unlawfully to land or to remain in Samoa; or
(e) Makes any declaration under clause 2 hereof which is wilfully false or misleading.
(2) In every case where a prohibited immigrant unlawfully lands in Samoa the master, charterer, and owner of the ship by which such prohibited immigrant was brought to Samoa shall be jointly and severally liable to a fine not exceeding £100 in respect of each such immigrant, and also to defray the expenses incurred by the Administration of Samoa in removing any such immigrant from Samoa, and in detaining and maintaining him in Samoa pending such removal.
OFFENCES RELATING TO PERMITS.
- (1) Every person to whom a permit has been granted shall be liable to a fine of £100 or to imprisonment for six months who—
(a) Fails to comply with the conditions, or any of them, subject to which the permit was granted; or
