The Samoa Immigration Order, 1930.

ORDER IN COUNCIL.
At Government House at Wellington, this 28th day of July, 1930.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
His Excellency the Governor-General of the Dominion of New
Zealand, acting by and with the advice and consent of the
Executive Council of that Dominion, and in pursuance of the authority
to make regulations for the peace, order, and good government of Samoa
conferred upon him by the Samoa Act, 1921, and of all other powers
and authorities enabling him in that behalf, doth hereby make the
following regulations.
REGULATIONS.

  1. This Order may be cited as "The Samoa Immigration Order, 1930," and shall come into force on the 11th day of August, 1930.
    PART I.—REGULATION OF IMMIGRANTS.
    RESTRICTIONS ON LANDING IN SAMOA.
  2. (1) Save with the authority of the Administrator and as here-
    inafter provided, no person shall land in Samoa from any place outside
    Samoa unless and until—
    (a) He shall have made and delivered to an officer of Customs or
    of Police a declaration in the form set out in the First
    Schedule hereto (but this paragraph shall not apply to persons
    under the age of fourteen years).
    (b) He shall have deposited with the Collector of Customs such
    sum (but not exceeding £50) as the Collector may deem
    necessary to defray the cost of transporting such person
    to a place outside Samoa where he will be permitted to
    land. But this paragraph shall not apply to—
    (i) Any permanent resident of Samoa returning thereto
    after a temporary absence therefrom;
    (ii) Any person who shall deposit with the Collector
    of Customs a ticket or other document which in the opinion
    of the Collector will entitle such person to obtain a passage
    away from Samoa at any time within five years from the
    date of the deposit without any further payment:
    (iii) Any person who shall deposit with the Collector
    of Customs good and sufficient security (to the satisfaction
    of the Collector) to indemnify the Administration of Samoa
    against any cost (but not exceeding £50) which it might be
    put to in transporting such person from Samoa and in
    maintaining him pending transportation.
    (2) Any person who lands in Samoa in breach of the provisions
    of this clause (apart from his liability to prosecution in accordance with
    the provisions hereinafter appearing) may be arrested and deported
    therefrom in the same manner as if he were a prohibited immigrant:
    Provided, however, that the said power of arrest and deportation shall
    be exercised only upon and in accordance with an authority in writing
    duly signed by the Administrator.
