Order in Council revoking certain Orders in Council under which the Waimea Electric-supply and Manufacturing Company, Ltd., is operating, and granting a License authorizing the Waimea Electric-supply and Manufacturing Company, Ltd., to use Water from the Wairoa River for the Purpose of generating Electricity and to erect Electric Lines in Portion of the Waimea County and in Richmond Borough and the Tahunanui Town District.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 17th day of December, 1929.

Present:

THE HONOURABLE G. W. FORBES, PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the Orders in Council described in the Second Schedule hereto, and, subject to the conditions set forth in the First Schedule hereto and to the regulations made under section two of the Public Works Amendment Act, 1911, and dated the eleventh day of July, one thousand nine hundred and twenty-seven, and published in the New Zealand Gazette of the twelfth day of the same month, or any regulations hereafter made in amendment thereof or substitution therefor (and hereinafter collectively referred to as “the regulations”), which regulations shall be deemed incorporated herein, doth hereby authorize the Waimea Electric Supply and Manufacturing Company, Ltd. (hereinafter referred to as “the licensee”), to take and use from the Wairoa River (hereinafter referred to as the “said river”) for the purposes hereinafter set forth the two streams of water (hereinafter described and referred to as “the said water”), not exceeding two hundred cubic feet per second at any one time, and also to erect and maintain electric lines for lighting, power, and heating purposes within the area of supply described in the First Schedule hereto; and the works and lines already erected in the said area of supply under the authority of the Orders in Council described in the Second Schedule hereto shall be deemed to be erected under this license, and the provisions hereof shall apply as fully and effectively as if this were the license originally issued, but nothing herein shall be held to guarantee that the said river contains the said water.

FIRST SCHEDULE.

PLANS.

THE licensee shall, before any new works hereby or hereafter authorized are commenced, forward for the approval of the Minister of Public Works (hereinafter referred to as “the Minister”)—

(a) Full detailed drawings and specifications of the diverting weirs:

(b) Drawings showing how and in what manner the water diverted is to be returned to the said river:

(c) Contour plans showing difference in level of water due to the construction of the headworks:

(d) Drawings, giving full particulars of any tunnels, aqueducts, and pipe-lines used in conveying the water from the headworks to the power-station:

(e) Drawings showing the arrangement of the generating, switching, and transforming plant in the power-station, and none of the said works or any portion thereof shall be commenced before the said approval is obtained:

(f) Any subsequent amendments or additions to plans already approved.

  1. UTILIZATION OF THE WATER.

The said water shall be used solely for the purpose of generating electricity and shall be returned to the Wairoa River at or near the power-houses.

  1. LOCATION OF HEADWORKS.

The said water shall be taken from the said river at the headworks of the upper station on Section 3, Block I, Waimea East, Block X, Waimea Survey District, and at the lower station on Section 170, Block X aforesaid, at points indicated on the six plans marked P.W.D. 32806, 45816, 53827, 54006, 54236, and 54372, deposited in the office of the Minister at Wellington, and hereinafter referred to as the “said plans.”

  1. GENERAL DESCRIPTION OF WORKS.

The licensee is hereby authorized, subject to the conditions herein contained, to construct, maintain, and use the following works for the purposes of this license, and to maintain and use for the same purposes the works already constructed, the position of the said works being indicated on the said plan.

(a) Headworks consisting of weirs and necessary intakes.

(b) Races, penstocks, and pipe-lines leading from such weirs to the power-houses hereinafter referred to; also tail-races from the power-houses to the said river.

(c) A power-house at each of the two stations with all necessary equipment, including water turbines, generators, transformers, lightning-arresters, switchboards, switches, exciters, and other appliances for generating electricity.

(d) Transmission and other lines over the routes shown by means of yellow lines on plan marked P.W.D. 74437, deposited in the office of the Minister of Public Works at Wellington.

(e) Such further transmission and other lines within the area of supply as may from time to time be required within such area of supply. Any extensions or alterations of lines pursuant to this paragraph shall be made only after compliance with the provisions of clause 21 of the regulations.

  1. INSPECTION OF WORKS.

The Inspecting Engineer, both during and after the construction of the works, shall have free access to and liberty at any time to inspect the same so as to ensure that the provisions of this license are given due effect to.

  1. MAINTENANCE OF WORKS.

The licensee shall maintain the works used under this license in proper working order during the continuance of the license.

  1. AREA OF SUPPLY.

The area of supply comprises that portion of the Waimea County bounded towards the south-west by the circumference of a circle with a radius of six miles from the licensee’s power-house on Section 3, Block X, Waimea Survey District, and passing through Sections 78, 73, 74, 96, 97, and part of Section XIX, Block VII, Waimea Survey District; thence on the east by a line about 12 chains east of the eastern boundary of said Section XIX; the eastern boundary of Section XV, Block VII aforesaid; Sections XV, 69, and 31, Block VIII, Waimea Survey District; thence on the north-east on a road through Section 28, Block IV, Waimea Survey District; thence on the west by a line from the north-western corner of the said Section 28 to and in line with the westernmost boundary of Section V, Block IV, Waimea Survey District, and the said westernmost boundary of the said Section V and portion of the eastern boundary of Section 10, Block IV, Waimea Survey District; thence on the north by the northern boundary of the said Section 10 and the continuation of such boundary to the road in Section II, Block IV aforesaid; thence on the north-east by the said road to a point opposite the northern boundary of Section I, Suburban South District; thence on the north by a line to and along the northern boundary of said Section I to the sea-coast; thence on the west by the sea-coast (including the land known as “the City Sands”) to the said circumference; as indicated by a black line and red border on the plan marked P.W.D. 39492, deposited in the office of the Minister of Public Works in the City of Wellington.

  1. POWER TO TAKE LAND.

The licensee is hereby empowered to take, under the Public Works Act, 1928, as for a public work, such land as may in the opinion of the Governor-General, be necessary to enable the licensee to construct and maintain the various works authorized by this license.

  1. RIGHT TO ENTER LANDS, ETC.

The Licensee shall have the right at any time or times during the continuance of this license with the consent of the Minister to enter upon any road or other land, whether vested in or occupied by the Crown or any other person or body corporate, and there to construct, erect, and lay down, maintain, renew, and repair all such water-channels, control gates, races, pipe-lines or other things as are required for the generation of electricity in pursuance of this license.

  1. DURATION OF LICENSE.

This license shall, unless sooner determined in accordance with the provisions hereinafter expressed, continue in force until the 1st day of April, 1959. Upon the expiry of the said
