  1. For the purposes of these regulations a lake and the mouth of a river or stream shall respectively be deemed to include every outlet of such lake, river, or stream respectively, and the seashore between the outlets of any such river or stream, and shall extend over a radius of one quarter of a mile from the point or line where the waters of such river, lake, or stream meet those of the sea or of any harbour at low water.

  2. No person shall buy, sell, or expose or offer for sale, or shall fish for the purpose of obtaining for sale, any trout, or any portion thereof.

  3. No person shall on any one day, take or kill more than fifteen trout, and no person shall continue to fish for trout on any day on which he has already taken or killed fifteen trout.

  4. No person shall fish for, take, or kill trout between the hours of 10 p.m. on any day and 4 a.m. on the following day.

  5. Except as provided for by the regulations regarding keeping trout in freezing-works or freezing-chambers during the close season which were made by the Governor in Council on the 6th day of October, 1908, and published in the New Zealand Gazette of the 8th day of the same month, no person shall have in his or her possession, whether frozen, chilled, or otherwise, any trout between the fifth day of May and the first day of October in any year: Provided that this regulation shall not apply to any trout taken by officers of the Government or by officers of the Waiapu Acclimatization Society for the purpose of fish culture or scientific investigation.

  6. The penalty for every breach of any of the preceding regulations shall be not less than 40s., and not more than £50.

FIRST SCHEDULE.

WAIAPU ACCLIMATIZATION DISTRICT.

ALL that area in the Gisborne Land District bounded by a line commencing at the south-western corner of Whangaparaoa No. 1 Block, and proceeding thence northerly, easterly, and southerly along the sea-coast to Pakarae No. 1 Block; along the northern boundary of that block to the Pakarae River, and up that river to and along the north-western boundary of Section 2, Block XIII, Uawa Survey District; along the northern boundary of Waimata North No. 1, the north-eastern boundaries of S.G. Run 58, Waimata North 1A 2, and along the northern boundary of S.G. Run 58 aforesaid, to a public road; along that road running north through S.G. Run 43 to the south-eastern boundary of Lot 1 of S.G. Run 43A; along the south-eastern and north-eastern boundaries of said Lot 1; along the south-eastern, northern, and north-western boundaries of S.G. Run 42 to Waiapu Inland Road; along that road to Waingaromia 1c Block; along the north-eastern boundary of that block to the Waingaromia River; up that river to and along the north-eastern boundary of Waipaoa 3B, the north-eastern boundary of Waipaoa No. 2, the eastern boundaries of Sections 1, Block IX, 2, Block V, and 1, Block VI, Tutamoe Survey District; westerly along the southern boundary Huiarua No. 3 Block, and northerly along the western boundary of that block to its intersection with a right line between Arowhana and Kapua Trig. Stations; thence north-easterly along that line, a right line to Whanakaoa Trig. Station, and a right line to Pakira Trig. Station; along the south-western and western boundaries of Waikura No. 2, the western boundary of Whangaparaoa No. 3A Block, and the southern boundary of Whangaparaoa No. 1 Block, to the point of commencement.

SECOND SCHEDULE.

LICENSE TO FISH.

The Fisheries Act, 1908, and its Amendments.

THE holder of this license [Name in full], of [Address], [Calling or occupation], having this day paid the sum of £ , is hereby authorized to fish with only one rod and line for trout in every Acclimatization District in New Zealand, except in Rotorua Acclimatization District and Taupo waters, from the day of , 19 , to the day of , 19 , subject to the said Acts and to the regulations made thereunder, and to the regulations for the time being in force in the Waiapu Acclimatization District, and to the local regulations for the time being in force in other Acclimatization Districts.

The North-western Side of Portion of Oates Street, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 5th day of December, 1929.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the twentieth day of November, one thousand nine hundred and twenty-nine, viz:—

“That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to portion of the north-western side of Oates Street, in the said City of Dunedin, where such portion of street abuts on Allotment 28, Township of Sunnyside, as the said portion of street is more particularly shown on the plan annexed hereto, and is thereon coloured brown and edged with red to its centre-line ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of Oates Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE north-western side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Oates Street, fronting Allotment 28, Township of Sunnyside. As the said portion of street is more particularly delineated on the plan marked P.W.D. 77221, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured brown and edged red.

Order in Council consenting to the Grey Electric-power Board borrowing Moneys by way of Bank Overdraft.

ORDER IN COUNCIL.

At the Government House at Wellington, this 5th day of December, 1929.

Present:

His Excellency the Governor-General in Council.

WHEREAS the Grey Electric-power Board (hereinafter called “the said local authority”) is desirous of borrowing moneys by way of bank overdraft, under section seventy, subsection one, of the Electric-power Boards Act, 1925:

And whereas the said local authority has complied with the provisions of the Local Government Loans Board Act, 1926 (hereinafter called “the said Act”), and it is expedient that the precedent consent of the Governor-General in Council under the said Act should be given to the borrowing as aforesaid on the terms and conditions hereinafter set forth:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by the said Act, and of all other powers and authorities enabling him in this behalf, doth hereby consent to the borrowing of moneys by the said local authority under the said section seventy, subsection one, to the following extent and subject to the following conditions:—

  1. Such borrowing may be from time to time by way of overdraft.

  2. The rate of interest payable from time to time shall not exceed current bank overdraft rates of interest to best customers.

  3. No money so borrowed shall be used for any purposes except that of meeting initial losses.

  4. No money shall be borrowed under this authority at any time after the 31st day of March, 1930.
