The North-western Side of Portion of the Takaka-Tarakohe Main Road in the County of Takaka exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 2nd day of September, 1929.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Takaka County Council on the sixth day of August, one thousand nine hundred and twenty-nine, the portion of road affected by such resolution being more particularly described in the Schedule hereto, viz. :—
“The Takaka County Council, being the local authority having control of the roads in the County of Takaka, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-western side of the portion of the Takaka - Tarakohe Main Road adjoining Lots 8, 9, 10, and 11 of Section 9, Takaka District ” ;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of the Takaka - Tarakohe Main Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.
SCHEDULE.
THE north-western side of all that portion of road known as the Takaka - Tarakohe Main Road situated in the Nelson Land District, County of Takaka, adjoining Lots 8, 9, 10, and 11 of Section 9, Takaka District, Block X, Waitapu Survey District. As the said portion of road is more particularly delineated on the plan marked P.W.D. 75386, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Vesting a Reserve in the Opunake Town Board.

ORDER IN COUNCIL.
At the Government House at Wellington, this 2nd day of September, 1929.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS the land described in the Schedule hereto has been duly set apart for municipal purposes: And whereas, in the opinion of the Governor-General, it is expedient to vest the said reserve in the Opunake Town Board: Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section nine of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that, from and after the day of the date hereof, the reserve described in the Schedule hereto shall become vested in the Opunake Town Board, in trust for municipal purposes, but reserving nevertheless to the Crown the right to use at any time the said reserve and the building now standing thereon (or any other building that may hereafter be erected in replacement thereof) free of charge for any military purpose.
SCHEDULE.
ALL that area in the Taranaki Land District, containing by admeasurement 1 rood, more or less, being Section 9, Block XXXVIII, Town of Opunake: Bounded towards the north-east by King Street, 126 links; towards the south-east by Section 11, Block XXXVIII aforesaid, 200 links; towards the south-west by Lots 1 and 2 (D.P. 4697), being parts of Section 10, and other part of said Section 10, Block XXXVIII aforesaid, 126 links; and towards the north-west by Section 7, Block XXXVIII aforesaid, 200 links: Be all the aforesaid linkages, more or less. As the same is delineated on the plan marked L. and S. 6/11/47, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.
