At the Government House at Wellington, this 29th day of July, 1929.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by section forty-four of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

Vincent Bower,
James Dalgety,
John Caldwell Foote,
William Ganley, sen.,
Edward Keane, and
Ernest Cecil Marshall

to be the Pipiroa Domain Board, having control of the land described in the Schedule hereto; and doth hereby appoint Saturday, the seventh day of September, one thousand nine hundred and twenty-nine, at one o’clock p.m., as the time when, and the Domain, Pipiroa, as the place where, the first meeting of the Board shall be held.

SCHEDULE.

PIPIROA DOMAIN.—AUCKLAND LAND DISTRICT.

SECTION 1, Block IV, Town of Pipiroa: Area, 8 acres 0 roods 16 perches.

Hugh Conning Murray,
Stanley Paul Parsons, and
William John Parsons

to be the Guthrie Domain Board, having control of the land described in the Schedule hereto; and doth hereby appoint Saturday, the thirty-first day of August, one thousand nine hundred and twenty-nine, at three o’clock p.m., as the time when, and the Guthrie School as the place where, the first meeting of the Board shall be held.

Extending Time for lodging Petitions for Inquiry with respect to General Election of Chatham Islands County Council.

ORDER IN COUNCIL.

At the Government House at Wellington, this 29th day of July, 1929.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS in terms of section sixty-five of the Counties Act, 1920, a general election of the Chatham Islands County Council (hereinafter referred to as “the said election”) was held on the eighth day of May, one thousand nine hundred and twenty-nine:

And whereas by section fifty-eight of the Local Elections and Polls Act, 1925 (hereinafter referred to as “the said Act”), it is in effect provided that a petition demanding an inquiry as to the conduct of any election or poll, or of any candidate or other person thereat, shall be filed in the Magistrate’s Court nearest to the principal polling-place at the election or poll to be inquired into in such one of the forms in the Second Schedule to the said Act as is applicable within fourteen days after the declaration of the result of the election or poll:

And whereas a petition for an inquiry into the election of a councillor at the said election for the Eastern Riding of the Chatham Islands County was filed in the Magistrate’s Court at Chatham Islands, but such petition did not comply with the provisions of section fifty-eight of the said Act:

And whereas it has been alleged that the proceedings in connection with the election of other councillors for the Chatham Islands County were not in conformity with law:

And whereas, on account of the distance of the Chatham Islands from the mainland of the Dominion of New Zealand and the infrequent conveyance of mails to and from the Chatham Islands, the filing of a petition demanding an inquiry with respect to the said election could not conveniently be done within the fourteen days prescribed by section fifty-eight of the said Act:

And whereas it is expedient to extend the period for filing any petition for an inquiry with respect to the said election:

Now, therefore, in pursuance and exercise of the powers and authorities conferred on him by section seventy-one of the said Act, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General of the said Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby extend until four o’clock in the afternoon of Thursday, the twenty-ninth day of August, one thousand nine hundred and twenty-nine, the time within which a petition may be filed in the Magistrate’s Court at Chatham Islands demanding an inquiry as to any matter connected with the said election which may be the subject of an inquiry under the provisions of the said section fifty-eight; and doth accordingly declare that any Stipendiary Magistrate exercising jurisdiction in the Magistrate’s Court at Chatham Islands shall, in respect of any such petition filed not later than four o’clock in the afternoon of the said twenty-ninth day of August, one thousand nine hundred and twenty-nine, have the same power to exercise the jurisdiction conferred upon him by the said Act as if such petition has been filed within fourteen days after the declaration of the result of the said election.
