an order is dated more than five years previously to the
receipt of the application, the Chief Judge of the Native Land
Court shall first obtain the consent of the Governor-General
in Council before making any order thereunder:
And whereas application has been made under the said
section to amend orders of the Native Land Court dated the
twenty-fourth day of September, one thousand eight hundred
and ninety-five, appointing successors to the interests of
Hare Pikoi (deceased), in Taikatiki and Waiaranga No. 1
Blocks:
Now therefore, His Excellency the Governor-General of
the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
doth hereby consent to the Chief Judge exercising with regard
to the said recited orders of the twenty-fourth day of September,
one thousand eight hundred and ninety-five, all and every the
jurisdiction granted to him by the said section seven, and
to the making of any such order thereunder as may seem
necessary or expedient.

Cancelling a Condition as to setting back the Building-line of
Portion of a New Street off Lake Road, in the Borough of
Takapuna, imposed by Order in Council under Section 128
of the Public Works Act, 1928.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby amend the Order in Council
dated the third day of April, one thousand nine hundred and
twenty-nine, and published in the New Zealand Gazette, No. 23,
of the fourth day of April, one thousand nine hundred and
twenty-nine, exempting a new street off Lake Road and
portion of street, being an extension of Gibbon's Road, in
the Borough of Takapuna, from the provisions of section
one hundred and twenty-eight of the Public Works Act,
1928, subject to a condition as to the building-line, by
cancelling the condition as to the building-line imposed by
the said Order in Council in so far as it affects Lot 3 of Lot 11
and Lot 4 of part Lot 12 of Allotment 31, Section 1, Parish
of Takapuna. As the same are more particularly delineated
on the plan marked P.W.D. 74908, deposited in the office of
the Minister of Public Works at Wellington, and thereon
coloured green.

of the said Dominion, doth hereby consent to the land described
in the Schedule hereto being taken for the purposes of a road.
