shillings per centum per annum, subject to the condition that the said local authority shall, before borrowing the said sum or any part thereof, make provision for the repayment thereof by establishing a sinking fund under the Local Bodies’ Loans Act, 1926, or under such other statutory enactment as may be applicable, and by making to such sinking fund payments at intervals of not more than one year at a rate or rates which shall be not less than the rate of five pounds two shillings per centum, such payments to be made in respect of every part of the said sum for the time being so borrowed and not repaid, and the first payment to be made not later than one year after the first day from which interest to the lender is computed on any moneys so borrowed.

Order in Council consenting to the Raising of a Loan of £3,000 by the Riverton Harbour Board.

ORDER IN COUNCIL.
At the Government House at Wellington, this 17th day of December, 1928.

His Excellency the Governor-General in Council.
WHEREAS the Riverton Harbour Board (hereinafter called “the said local authority”) is desirous of raising the sum of three thousand pounds for the purpose of redeeming portions of the Harbour Board’s loans maturing in 1928–29, by a loan to be known as “Harbour Improvements Redemption Loan, 1928 (No. 2)”:
And whereas the said local authority has complied with the provisions of the Local Government Loans Board Act, 1926 (hereinafter called “the said Act”), and it is expedient that the precedent consent of the Governor-General in Council under the said Act should be given to the raising of the said loan on the terms and conditions hereinafter set forth:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by the Local Government Loans Board Act, 1926, and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising by the said local authority of the said loan up to the amount of three thousand pounds for a term expiring on the thirty-first day of March, one thousand nine hundred and twenty-nine, at such rate or rates of interest as shall not produce to the lenders a rate exceeding the rate of five pounds ten shillings per centum per annum, subject to the condition that the said local authority shall repay the said sum on maturity date out of unexpended loan-moneys at present held by the said local authority.

Directing Sale of Railway Land, at Khandallah, under the Public Works Act, 1908.

ORDER IN COUNCIL.
At the Government House at Wellington, this 10th day of December, 1928.

His Excellency the Governor-General in Council.
WHEREAS by the thirtieth section of the Public Works Act, 1908 (hereinafter termed “the said Act”), it is enacted that if it is found that any land held, taken, purchased, or acquired at any time under this or any other Act or Provincial Ordinance, or otherwise howsoever, for any public work is not required for such public work, the Governor-General may, by Order in Council publicly notified and gazetted, cause the same to be sold under the conditions set forth in the said Act:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare the sale of the surface of the land mentioned in the First Schedule hereto, together with that part of the subsoil on such land as is described in the Second Schedule hereto.
FIRST SCHEDULE.
APPROXIMATE area of the piece of land: 13·33 perches.
Portion of Railway Reserve (part Sections 4 and 5, Porirua), Block XI, Belmont Survey District, City of Wellington. (S.O. 2423.)
SECOND SCHEDULE.
As to the area mentioned in the First Schedule: All the subsoil down to a plane 40 ft. above and parallel to the rail-level, such plane being horizontal transversely to the said rail-level.
In the Wellington Land District: as the same is more particularly delineated on the plan marked L.O. 13, deposited in the office of the Minister of Railways, at Wellington, and thereon bordered red.

Licensing Thomas Percival Lane to use and occupy a Part of the Foreshore at Rawene, in Hokianga Harbour.

ORDER IN COUNCIL.
At the Government House at Wellington, this 17th day of December, 1928.

His Excellency the Governor-General in Council.
WHEREAS by Order in Council dated the tenth day of August, one thousand nine hundred and fourteen, and published in the New Zealand Gazette No. 84, of the thirteenth day of the same month, Thomas Percival Lane, of Rawene, who, with his executors, administrators, and assigns is hereinafter referred to as “the licensee,” was licensed to use and occupy a part of the foreshore, at Rawene, in Hokianga Harbour, as a site for a general store and offices, and shown as site No. 9, on plans marked M.D. 4288 and 4289, and deposited in the office of the Marine Department at Wellington, for the term of fourteen years, computed from the tenth day of August, one thousand nine hundred and fourteen:
And whereas the said licensee has applied for a fresh license under the Harbours Act, 1923 (hereinafter called “the said Act”), for a further term of fourteen years, and it is advisable to grant the same:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the purpose or object for which the said license is required by the licensee as aforesaid; and, in further pursuance and exercise of the said power and authority, and with the like advice and consent as aforesaid, doth hereby license and permit the licensee to use and occupy that part of the foreshore marked as site No. 9 on plans M.D. 4288 and 4289, so deposited as aforesaid, for the purpose aforesaid, such license to be held and enjoyed by the licensee and upon and subject to the terms and conditions set forth in the Schedule hereto.
SCHEDULE.
- In these conditions the term—
“Foreshore” means such parts of the bed, shore, or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tides:
“Low-water” means low-water mark at ordinary spring tides:
“Minister” means the Minister of Marine as defined by the Shipping and Seamen Act, 1908, and includes any officer, person, or authority acting by or under the direction of such Minister.

The concessions and privileges conferred by this Order in Council shall extend and apply only to that part of the foreshore necessary for the maintenance of the said general store and offices as shown as site No. 9 on the plans marked M.D. 4288 and 4289, and deposited in the office of the Marine Department as aforesaid.

In consideration of the concessions and privileges granted by this Order in Council, the licensee shall pay to the Minister the sum of £2 10s., and thereafter an annual sum of £5, in advance, payable on the 1st day of April in each year, the proportionate part of such rental in respect of the period from the 10th day of August, 1928, until the 31st March following to be paid on the licensee being supplied with a copy of this Order in Council.
