resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to both sides of portion of that street in the City of Dunedin known as Fitzroy Street, where the same abuts on parts of Sections 44 and 45, Block VII, Town District, as the said portion of street is shown on the plan attached hereto, and thereon coloured brown and edged with red”; subject to the condition that no building or part of a building shall at any time be erected on the land fronting either side of the portion of Fitzroy Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

ALL that portion of street situated in the Otago Land District, City of Dunedin, known as Fitzroy Street, fronting part Sections 44 and 45, Block VII, Town District. As the said portion of street is more particularly delineated on the plan marked P.W.D. 73501, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured brown and edged red.

Vesting Control of a Reserve under the Tourist and Health Resorts Control Act, 1908.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 25th day of October, 1928.

Present:

THE RIGHT HONOURABLE SIR FRANCIS BELL, P.C., PRESIDING IN COUNCIL.

IN pursuance and exercise of the power and authority conferred on him by section five of the Tourist and Health Resorts Control Act, 1908 (hereinafter termed “the said Act”), His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby vest the control of the reserve for an addition to a hot-springs reserve described in the Schedule hereto in the Minister of the Crown for the time being having the administration of the said Act, and doth hereby declare that the said reserve shall be administered under the said Act.

SCHEDULE.

GISBORNE LAND DISTRICT.

Lot 1 of Suburban Section 118, Te Puia Township, Block XVI, Mata Survey District: Area, 1 acre 2 roods.

The Eastern Side of Portion of Creswick Terrace, in the City of Wellington, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

At the Government Buildings at Wellington, this 25th day of October, 1928.

THE RIGHT HONOURABLE SIR FRANCIS BELL, P.C., PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the twentieth day of October, one thousand nine hundred and twenty-seven, viz.:

“The Wellington City Council, being the local authority having control of the streets in the City of Wellington, hereby declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the eastern side of that portion of Creswick Terrace beginning at the south-western corner of Lot 1, D.P. 1742, and extending for a distance of approximately 363·64 links, being the part of Creswick Terrace fronting Lots 27, 28, 29, and 30, Deeds Plan 108, part Section 32, Karori Registration District, or as more particularly delineated on Certificate of Title, Vol. 341, folio 195, in office of District Land Registrar”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Creswick Terrace (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE eastern side of all that portion of street situated in the Wellington Land District, City of Wellington, known as Creswick Terrace, fronting Lots 27, 28, 29, and 30, Deeds Plan 108, being part Section 32, Karori District. As the said portion of street is more particularly delineated on the plan marked P.W.D. 73627, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

License authorizing Sullivan Brothers, of Weheka, to use Water from a Tributary of the Clearwater River for the Purpose of generating Electricity, and to erect and use Electric Lines within Portion of the Westland County.

IN pursuance and exercise of the powers conferred by the Public Works Amendment Act, 1908, the Public Works Amendment Act, 1911, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth—subject to the conditions hereinafter set forth, and to the regulations made under section two of the Public Works Amendment Act, 1911, on the eleventh day of July, one thousand nine hundred and twenty-seven, and published in the New Zealand Gazette of the twelfth day of the same month, or any regulations hereafter made in amendment thereof or in substitution therefor (such regulations which are deemed to be incorporated herein, being hereinafter collectively referred to as “the regulations”)—hereby grant to Sullivan Brothers, of Weheka, hotel-keepers (hereinafter with their successors and assigns referred to as “the licensee”), a license to take and use from a tributary (hereinafter referred to as “the said stream”) of the Clearwater River, in the Westland Land District, for the purposes hereinafter set forth, a stream of water (hereinafter referred to as “the said water”) not exceeding eight cubic feet per second respectively at any one time; and also to lay, construct, put up, place, and use the electric lines hereinafter described on the following conditions. Nothing herein shall be held to guarantee that the said stream contains sufficient water to supply the volume of water hereinbefore referred to; and all rights hereby granted shall be subject to all existing rights heretofore granted under the Mining Acts or otherwise.

CONDITIONS.

  1. PLANS.

THE licensee shall, before the works hereby authorized are commenced, forward for the approval of the Minister of Public Works (hereinafter referred to as “the Minister”)—
(a) Full detailed drawings and specifications of the diverting weirs:
(b) Drawings showing how and in what manner the water diverted is to be returned to the said stream:
(c) Contour-plans showing difference in level of water due to the construction of the headworks:
(d) Drawings giving full particulars of any tunnels, aqueducts, and pipe-lines used in conveying the water from the headworks to the power-station.
(e) Drawings showing the arrangement of the generating, switching, and transforming plant in the power-station:

and none of the said works or any portion thereof shall be commenced before the said approval is obtained.
