The North-eastern Side of Portion of Findlay Street, in the Ellerslie Town District, exempted from the Provisions of Section 117 of the Public Works Act, 1908.

ORDER IN COUNCIL.
At the Government House at Wellington, this 13th day of August, 1928.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Ellerslie Town Board on the twenty-ninth day of May, one thousand nine hundred and twenty-eight, viz.:

“That that the Ellerslie Town Board, having control of the street known as Findlay Street, Ellerslie, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of the said street shown coloured red on the plan hereunto annexed, fronting Lots Numbers 1, 2, and 3 on a plan deposited in the Land Registry Office at Auckland under Number 20524, being part of Lot 1 of the subdivision of part of Allotments 7 and 59 of Section 12 of the Suburbs of Auckland;
such portion of street being described in the Schedule hereto.

SCHEDULE.

THE north-eastern side of all that portion of street, situated in the North Auckland Land District, Ellerslie Town District, known as Findlay Street, fronting Lots 1, 2, and 3, D.P. 20524, being part of Lot 1 of a subdivision of part Allotments 7 and 59 of Section 12, Suburbs of Auckland. As the said portion of street is more particularly delineated on the plan marked P.W.D. 72529, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Recreation Reserve in Otago Land District brought under Part II of the Public Reserves and Domains Act, 1908.

ORDER IN COUNCIL.
At the Government House at Wellington, this 13th day of August, 1928.

Present:

His Excellency the Governor-General in Council.

BY virtue of the powers and authorities vested in me by the twenty-sixth section of the Public Reserves and Domains Act, 1908, I, General Sir Charles Fergusson, Baronet, Governor-General of the Dominion of New Zealand, by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the reserve for recreation in the Otago Land District described in the Schedule hereto shall be and the same is hereby brought under the operation of, and declared to be subject to, the provisions of Part II of the said Act; and such reserve shall hereafter form part of the Waihemo Domain, and be managed, administered, and dealt with as a public domain by the Waihemo Domain Board.

SCHEDULE.

ALL that area in the Otago Land District containing by admeasurement 4 acres 1 rood 30 perches, more or less, being part of Section 25, Block VIII, Moeraki Survey District, and bounded as follows: Towards the north by part Section 25, 83° 8′, 650·5 links; towards the east by part Section 25, 173° 8′, 733 links; towards the south by a public road, 387·3 links, 200 links, and 123·6 links; and towards the west by the Shag River, 548·6 links; be all the aforesaid linkages more or less. As the same is more particularly shown on the plan marked L. and S. 1/506, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Setting aside Native Land as a Native Reservation.

ORDER IN COUNCIL.
At the Government House at Wellington, this 13th day of August, 1928.

Present:

His Excellency the Governor-General in Council.

WHEREAS by section two hundred and thirty-two of the Native Land Act, 1909, it is enacted, inter alia, that when any Native freehold land is owned at law or in equity by more than ten owners in common the Governor-General may, by Order in Council, set apart and reserve any part of that land for the common use of the owners thereof as in the said Act provided:

And whereas the Native Land Court has recommended that the land described in the Schedule hereto be so set apart and reserved:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority hereinbefore mentioned, and all other powers thereunto him enabling, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby set apart and reserve the Native freehold land described in the Schedule hereto, for the common use of the owners thereof as a meeting-place and a place of historical interest.

SCHEDULE.

BLOCK II, TUHUA SURVEY DISTRICT.

ALL that area of land situate in the Aotea Native Land Court District, called or known as Paora Aneti Nos. 17 and 18 Block, containing 45 acres 0 roods 30 perches, more or less, and being the whole of the land comprised in a partition order of the Native Land Court dated the 9th July, 1915.

Regulation under the Stamp Duties Act, 1923.

ORDER IN COUNCIL.
At the Government House at Wellington, this 13th day of August, 1928.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred by the Stamp Duties Act, 1923 (hereinafter referred to as the said Act), and of all other powers and authorities enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the clause numbered 8 of the regulations under the said Act, made by Order in Council on the fourth day of March, one thousand nine hundred and twenty-four, and published in the Gazette on the sixth day of the same month at page 628, and in lieu thereof doth hereby make the regulation hereinafter set forth, and doth hereby declare that such revocation shall take effect and the regulation made shall come into force on the date of publication of this Order in Council in the Gazette.

REGULATION.

  1. (a) A DISCOUNT of £2 10s. per centum shall be allowed by Postmasters or by the Stamp Duties Office on all purchases of £2 worth or more of stamps of a denomination not exceeding 1s., if made by licensed dealers holding a license in existence at the date of coming into force of this regulation.

(b) Licenses hereafter granted shall, in the discretion of the Commissioner, be granted on terms either that the discount referred to in paragraph (a) of this regulation or that no discount shall on the purchase of stamps be allowed to the person so licensed.
