IN pursuance and exercise of the powers conferred by
section twelve of the Land Act, 1924, I, General Sir
Charles Fergusson, Baronet, Governor-General of the Do-
minion of New Zealand, do hereby proclaim as closed the
portion of road in Hapuakohe Survey District described in the
Schedule hereto.

Defining the Middle-line of a Road in Block IX, Paekakariki
Survey District -viz., a Deviation of the Wellington-Auckland
(via Taranaki) Main Highway.

A PROCLAMATION.

IN pursuance and exercise of the powers and authorities
vested in me by the Public Works Act, 1908, the Public
Works Amendment Act, 1923, and of every other power and
authority in anywise enabling me in that behalf, I, General
Sir Charles Fergusson, Baronet, Governor-General of the
Dominion of New Zealand, do hereby proclaim and declare
that the middle-line of the road desired to be constructed
over Block IX, Paekakariki Survey Districtβ€”viz., a deviation
of the Wellington-Auckland (via Taranaki) Main Highwayβ€”
shall be that defined and set forth in the Schedule hereto.

SCHEDULE.

COMMENCING at a point on the Wellington-Auckland (via
Taranaki) Main Highway in Section 67, Block IX, Paekakariki
Survey District, and proceeding thence in a north-westerly
direction generally, passing in, into, through, or over the said
Section 67 and Section 68, Block IX, Paekakariki Survey
District, and terminating at a point on the said main highway
in the said Section 68, being a distance of 26 chains, more
or less : including all adjoining and intervening places, lands

reserves, roads, tracks, lakes, rivers, streams, and water-
courses. All in the Wellington Land District : as the same
is delineated on the plan marked P.W.D. 72201, deposited
in the office of the Minister of Public Works at Wellington.

Given under the hand of His Excellency the Governor-
General of the Dominion of New Zealand, and issued
under the Seal of that Dominion, this 23rd day of May,

Authorizing the New Plymouth High School Board to have
Use and Control of Buildings, &c.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 10th day of
May, 1928.
Present:
THE RIGHT HONOURABLE J. G. Coates, P.C., PRESIDING IN
COUNCIL.

IN pursuance and exercise of the powers conferred upon
him by the Local Legislation Act, 1927, and of all other
powers enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby authorize and empower
the New Plymouth High School Board to have the use and
control of the buildings, equipment, plant, and other chattels
specified in the First Schedule hereto, on the terms and
conditions set forth in the Second Schedule hereto, and with
the like advice and consent, doth prescribe that this Order
shall come into force on the date of publication thereof in the
New Zealand Gazette.

FIRST SCHEDULE.

THE whole of the main Technical School building fronting
Liardet Street, and all subsidiary buildings, including engineer-
ing workshops, latrines, and storerooms, with all equipment
used or available for use therein for the conduct of technical
school classes at the 31st day of December, 1927; with the
exception of the manual woodwork-room and its contents; and
also (by way of inclusion and not of exception) the grounds
surrounding and connecting the specified buildings.

SECOND SCHEDULE.

  1. THE New Plymouth High School Board shall have the
    sole right to the use of the buildings, equipment, plant, and
    chattels specified in the First Schedule hereto, and shall at
    all times have free access to such buildings, and free use for
    the purposes of a technical school of the grounds surrounding
    and connecting the specified buildings: Provided that the
    Education Board of the District of Taranaki shall have the
    right of free access at all times for motor or other traffic to
    its storeroom, garages, and other buildings through the
    grounds between the main technical school building and the
    engineering workshop building.

  2. The Education Board of the District of Taranaki shall
    not place on any part of the grounds on the western side or
    within 20 ft. on the eastern side of the vertical plane nearest
    to the Education Office which passes through corners of the
    main Technical School and the Engineering Workshop build-
    ings without intersecting either building, any fence, ob-
    struction, or erection, temporary or permanent, without the
    consent previously obtained of the New Plymouth High School
    Board.

  3. The New Plymouth High School Board shall not place
    any fence, obstruction, or erection, temporary or permanent,
    on any part of the grounds surrounding the buildings of
    which it has the sole use without the consent previously
    obtained of the Education Board of the District of Taranaki.

  4. The New Plymouth High School Board shall be re-
    sponsible for the proper maintenance, lighting, heating,
    cleaning, and caretaking of the buildings and equipment,
    plant, and chattels of which it has the sole use in all respects
    as if it held the freehold of such buildings, and shall also
    maintain in good order and condition that part of the
    grounds of which it has the free use for the purposes of a
    technical school as aforesaid.

  5. The New Plymouth High School Board shall pay all
    rates, water, lighting, and other charges which may become
    due in respect of the land and buildings described in the
    First Schedule hereof.
